RE: Aviara Master Plan Agreement for Inclusionary Housing/Affordable Housing Development Agreement
Dear Marty:
By its resolution No. 92-276 adopted September 1, 1992, the Carlsbad City Council
approved the Aviara Master Plan Agreement for Inclusionary Housing (:'Agreement") as
between Aviara Land Associates Limited Partnership, a Delaware limited partnership
("Aviara") and the City of Carlsbad ("City"). Pursuant to that resohtion, the Agreement
/ will be mutually executed by Aviara and City, this week.
Aviara has met with you and your staff for a preliminary discussion with respect to
certain property (herein the "Little Bressi Site"), which is not a part of the Aviara
Master Plan. Aviara has the Little Bressi Site under an option in accordance with an greement dated June 1, 1992AThe purpose of this letter is to inform you that
reby identifies the Little Bressi site as the proposed location for construction
of Aviara affordable units, and that Aviara proposes that such construction will, among tother things, satisfy all requirements of Section 3.2.2(b) of the Agreement. )
Pursuant to Section 3.2.4 of the Agreement, the satisfaction of such conditions will,
among other things, entitle Aviara to the benefits of the AffordabIe Housing
Development Agreement, a draft of which is attached to the Agreement as Exhibit "C'.
Accordingly, pursuant to the Agreement, Aviara hereby requests that the City begin its
processing of the proposed Affordable Housing Development Agreement in accordance
witb Chapter 21.70 of the Carlsbad Municipal Code, and schedule review of the Agreement for the soonest available Planning Commission, and Housing and Development Advisory Committee meetings.
Please confirm our understanding that, based upon this letter and other information and
materials you have received, Aviara's application for such Affordable Housing
Development Agreement is complete as required by Chapter 21.70. If not complete,
