On September 13, 2010, Coastal Commission advised the appeal had been withdrawn and that the CDP was valid. See attached project description p-15 Page 3 of 3 Revised 09/11 ^ CITY OF CARLSBAD STORM WATER STANDARDS QUESTIONNAIRE E-34 Development Services Land Development Engineering. 1635 Faraday Avenue 760-602-2750 www.carlsbadca .gov INSTRUCTIONS: To address post-development pollutants that may be generated from development projects, the City requires that new development and significant redevelopment priority projects incorporate Permanent Storm Water Best Management Practices (BMP's) into the project design per the City's Standard Urban Stomiwater Management Plan (SUSMP). Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary permits and/or constmction permits). The results of the questionnaire determine the level of storm water standards that must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to 'Standard Stormwater Requirements' or be subject additional criteria called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the storm water standards applied to a project. Applicant responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than initially assessed by the applicant, this will result in the retum of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City. If applicants are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, they are advised to seek assistance from Land Development Engineering staff. A separate completed and signed questionnaire must be submitted for each new development application submission. Only one completed and signed questionnaire is required when multiple development applications for the same project are submitted concurrently. In addition to this questionnaire, applicants for construction permits must also complete, sign and submit a Project Threat Assessment Form to address constmction aspects of the project. Please answer the questions below, follow the instructions and sign the form at the end. 1. Is your project a significant redevelopment? DEFINITION: Significant redevelopment is defined as the creation, addition or replacement of at least 5,000 square feet of impervious surface on an already existing developed site. Significant redevelopment includes, but is not limited to: the expansion of a building footprint; addition to or replacement of a structure; structural development including an increase in gross floor area and/or exterior construction remodeling; replacement of an impervious surface that is not part of a routine maintenance activity; and land disturbing activities related with structural or impervious surfaces. Replacement of impervious surfaces includes any activity that is not part of a routine maintenance activity where impervious material(s) are removed, exposing underlying soil during construction. If your project IS considered significant redevelopment, then please skip Section 1 and proceed with Section 2. In most cases linear pathway projects that are fbr infrequent vehicle use, such as emergency or maintenance access, or for pedestrian or bicycle use, are not considered Pollutant-generating Development Projects if they are built with pervious surfaces or if they sheet flow to surrounding pervious surfaces. Time for public hearing EXHIBIT 7 PROPOSED NEW CHAPTER 6.3 TO BE ADDED TO CITY OF CARLSBAD DRAINAGE MASTER PLAN 6.3 Comprehensive Watershed Management Planning Comprehensive watershed management planning is critical for ensuring the protection, restoration, and enhancement of the quality and beneficial uses of water, habitats, and other natural resoiarces within a watershed. The Carlsbad drainage basins are part of group of basins that together form the Carlsbad Hydrologic Unit (CHU). The Carlsbad Hydrologic Unit covers 210 square miles including portions of Oceanside, Vista, San Marcos, Escondido, Encinitas, Solana Beach, Carlsbad and unincorporated San Diego County. The CHU includes seven adjacent coastal watersheds that drain to the Pacific Ocean including the Loma Alta Creek, Buena Vista Creek, Agua Hedionda Creek, Canyon del Encinas Creek, San Marcos Creek, Cottonwood Creek and Escondido Creek. The CHU contains four major coastal lagoons: Buena Vista, Agua Hedionda, Batiquitos and San Elijo, as well as, the Loma Alta Slough. The CHU also includes three lakes, two storage reservoirs, urban and natural drainage, native habitats, open space, beaches, recreational activities, agriculture, aqua farms, power and desalination plants. In 1998, the Carlsbad Watershed Network (CWN) was formed to support and develop coordinated efforts for the protection and improvement of the CHU. The membership of the CWN includes representatives fi-om the various local city jxuisdictions, the county, lagoon foundations, resource agencies, environmental and citizen groups, other interested non-profit groups, educational and research institutions. In 1999, The State Water Resource Control Board awarded a Clean Water Act Section 205(j) grant to the Carlsbad Watershed Network to develop a management plan for the coastal watersheds of the Carlsbad Hydrologic Unit. The plan, referred to as the Carlsbad Watershed Management Plan (CWMP), was completed and released to the public in February 2002. (See projectcleanwater.org for more information) The vision statement for the Carlsbad Watershed Management Plan is as follows: "Protect, restore, and enhance the quality and beneficial uses of water, habitats, and other natural resources of the watersheds of the Carlsbad Hydrologic Unit and the adjacent coastal shoreline." The following goals were established by the CWN in support of the Carlsbad Watershed Management Plan vision statement: Goal 1: Protect, restore and expand the undeveloped open space that will provide self sustaining hydrologic and habitat connections. • Purchase or transfer into public ownership as many of these resources as possible, including functional buffers needed for protection. 34 EXHIBIT? Goal 2: Protect public healfli by preventing and minimizing health risks to users (human & wildlife) of local water resources. • Establish a monitoring program to assure continued protection, • Develop a method of ranking severity of problems. • Detennine a process for making the data publicly accessible through an Intemet database, • Recognize that public health includes flood protection. Goal 3: Protect, restore and enhance beneficial water uses and environmental health. • Strive for balance between human uses, planned development and resource protection. Goal 4: Facilitate coordinated efforts among cities, regulatory agencies and environmental organizations to implement watershed management policies and physical improvements at the most functional locations in the most effective manner, without restrictions to political boundaries. Goal 5: Educate to increase the public's knowledge, understanding and appreciation of local watersheds and associated water resources. • Develop an educational program to explain the importance of open space in protecting areas and provide public access to these areas. • Develop individual and organizational stewardship and financial responsibility through programs, training and restoration activities. • Establish monitoring protocols and training for citizen monitoring. In 2007, the City of Vista working in cooperation with the CWN secured a grant fi:om the State Water Resources Control Board for preparation of a watershed management plan for the Agua Hedionda Watershed referred to as the Agua Hedionda Watershed Management Plan (AHWMP). The purpose of the AHWMP is to provide a comprehensive plan to restore watershed fimctions and minimize future degradation of the Agua Hedionda Watershed. The AHWMP differs from the CWMP in that the AHWMP evaluated and assessed specific existing and proposed watershed conditions and characteristics of the Agua Hedionda Watershed and recommended specific watershed management opportunities and implementation actions to meet the CWMP goals. The Agua Hedionda Watershed Management Plan (AHWMP) was completed in August 2008. The City of Carlsbad will continue to collaborate with the CWN on the implementation of the Carlsbad Watershed Management Plan, the Agua Hedionda Watershed Management Plan and any other future sub-watershed plans addressing the Carlsbad Hydrologic Unit. The City will endeavor to incorporate the various watershed planning goal elements, watershed management opportunities and action items into the planning, design, construction and maintenance of its future drainage facility projects. The City will also endeavor to incorporate applicable watershed planning goal elements and action items into the City Standard Urban Storm Water Management Plan (SUSMP) and other elements of the Carlsbad Storm Water Standards Manual. Incorporating the various elements and items as noted may first require amendment of the Drainage Master Plan and Local Coastal Program and environmental review that is in addition to the EIR prepared for this Drainage Master Plan. AGUA HEDIONDA AND CALAVERA CREEKS DREDGING AND IMPROVEMENTS PROJECT DESCRIPTION 1.0 Proiect Purpose and Background The City proposes to conduct drainage infrastructure modifications along Agua Hedionda and Calavera Creeks to provide enhanced flood protection for the residential community of Rancho Carlsbad, an existing residential mobile home community located east of El Camino Real and south of Cannon Road, in the northeastern section of Carlsbad (Figure 1). Over 50 percent of the homes in Rancho Carlsbad are located within the existing limits of the 100-year floodplain and could be subject to flood damage during a major storm event. 2.0 Previous Channel Configuration Work The original segments of Agua Hedionda and Calavera creeks were reconstructed as man-made, earthen trapezoidal channels in conjunction with the development of the Rancho Carlsbad community development according to plans dated June 1969. Approximately 1.2 miles of the Agua Hedionda and Calavera creeks were reconstructed and channelized as part of the overall development for the Rancho Carlsbad community. In 1998, additional channel enhancement and repair work occurred west of El Camino Real with the construction of Cannon Road Bridge over Agua Hedionda Creek. 2.1 Emergency Dredge Work In March 2006 emergency channel dredging was conducted in portions of Agua Hedionda and Calavera creeks to provide immediate flood protection for the residential community of Rancho Carlsbad. The City obtained the following regulatory authorizations to conduct the emergency flood control dredging: • Clean Water Act (CWA) Section 401 Water Quality Certification (06C-007) by the San Diego RWQCB • CDFG California Fish and Game Code Section 1602 Streambed Alteration Agreement Notification No. 1600-2006-0060-R5 (1602) • USAGE 404 Individual Permit (200600151 -KJC) • Emergency Coastal Development Permit, issued by the City on February 6, 2006, pursuant to Carlsbad Municipal Code 21.201.190 Emergency dredge work was started on March 4, 2006, and was completed on March 28, 2006. The total extent of the emergency dredging in Agua Hedionda Creek spanned from the upstream edge of the Cannon Road Bridge to approximately 3,000 feet upstream, 80 feet downgradient of the West Rancho Carlsbad Drive Bridge. The emergency dredge activities were required to address immediate flood control and public safety needs of the Rancho Carlsbad community. 3.0 Description of Proiect Components The following section describes the proposed project features for the work in Agua Hedionda Creek and Calavera Creek. 3.1 Agua Hedionda Project Components Agua Hedionda Creek work would involve sediment removal, and widening and deepening the creek along approximately 3,000 linear feet (LF) of the channel bottom from near Rancho Carlsbad Drive to the downstream edge of Cannon Road Bridge. Between El Camino Real Bridge and the confluence with Calavera Creek, Agua Hedionda Creek would be excavated to an average bottom width of 85 feet with 1.5:1 riprap-protected side slopes, representing a widening of approximately 27 feet (20 ft to 32 ft channel widening range). Between Cannon Road Bridge and El Camino Real Bridge, the channel would be excavated to existing riprap levels in the main channel and side slopes. Upstream of the confluence of Agua Hedionda and Calavera Creeks, Agua Hedionda Creek would be dredged up to 6 feet in depth, with a bottom width of 40 feet and 1.5:1 H:V riprap protected side slopes. Consistent with the recommendations of the geotechnical study (Ninyo & Moore 2006), side slopes higher than 12 feet would be constructed at a 2:1 H:V slope to maintain stability. Dredging in Agua Hedionda Creek is anticipated to generate approximately 34,000 cubic yards (cy) of material. In addition, for channel side slope stability, 4,300 cy of Vi ton and 2,800 cy of Light riprap would be installed along 2,535 linear feet (1.39 acres) of newly constructed toe of slope as shown in Detail A below. The project would also involve the installation of one extended riprap drop structure to control velocity. The drop structure is provided in a drop-structure detail. Drop-structure construction would require 6,400 cy of 4-ton and 4,000 cy of half-ton riprap over 0.73 acre. Approximately 50 cy of material would be dredged from the creek (square feet per acre). Additional work would involve installation of six gabion drop structures. No riprap slope protection is proposed along Calavera Creek outside of the gabion structure areas; however, riprap would be installed upstream and downstream of the gabion drop structures. Gabion structure installation would result in 163 cy of fill and 0.03 acre of impact. Riprap installation would include 1,400 cy of half-ton riprap and 600 cy of light riprap. Riprap installation would occur over 0.41 acre. An existing ornamental wall (approximately 380 LF) adjacent to Calavera Creek would be removed to allow for access during construction activities. The ornamental wall would be reconstructed following dredging and improvements to the creek. Proposed locations of the wall removal and creek and slope repair and enhancements (including removal and replacement of overside drains, installation of six permanent drop structures, and removal of concrete and replacement with Vmax or other altemative) are illustrated in Figure 2. In addition, a typical cross-section of the gabions is provided in Detail C below. 3 Detail C - Gabion Detail 100-YEAR WATER SURFACE ELEVATION STA 2+00 FG= 34,00' STA 2+03 FG = 35.50' \ 12-0" 3.3 Access Road CALAVERA CREEK GABION PROFILE @ STA 2+03 An access road would be constructed near the confluence of Agua Hedionda and Calavera creeks to provide access for dredging equipment in the creeks (Figure 2). Approximately 5,000 cy of material would be excavated from an elevated area above the creek bank to construct the access road. Rock slope protection would be installed for slope stability. An additional access road would be constructed to enter Agua Hedionda Creek between the El Camino and Cannon Road bridges (Figure 2). The proposed access road would extend from the existing paved access road, which is shown as a staging area in Figure 2. 3.4 Maintenance Plan Included in this project are routine maintenance activities necessary to preserve the flood protection of the community. Maintenance activities will begin prior to the start of the rainy season that include sediment removal and rip rap repairs. All maintenance activities will not take place during the migratory bird nesting season. Annually, the creek will be inspected for vegetation growth and sedimentation. Twice a year the channel will be inspected and cleaned of debris that could hinder the intended function of the channel and trash material. Vegetation removal will occur when the average height of vegetation reaches two feet. Vegetation within the rip rap will be removed annually. Monitoring posts will be installed and when the sedimentation exceeds 0.5 feet above the design bottom, it will be removed. 4.0 Impacts to .Turisdictiohal Waters of the U.S. and State The Table 1 below identifies the quantity of jurisdictional waters of the U.S. and State, including wetlands within the project site. All jurisdictional area within the project site will be impacted by the dredging and improvements in Agua Hedionda and Calavera creeks (Figures 2-7). In addition, ongoing channel maintenance activities will occur within the project site; therefore, impacts to jurisdictional area are being classified as permanent impacts. Of the 5.17 acres of impacts in Agua Hedionda Creek, 0.75 acre is located within the Coastal Zone (between the El Camino Real and Cannon Road Bridges). Calavera Creek is not located within the Coastal Zone. Table 1. Substituting one erosion control structure for another erosion control structure that is equivalent and will not create an adverse environmental effect, is within the scope of the project and does not require any additional permits or environmental review. However, the project may also include riprap on both sides of Agua Hedionda Creek for approximately 3,000 If as well as riprap along the creek bottom between drop structures downstream ofthe Rancho Carlsbad Drive bridge. Comments received on the project in 2007 and 2008 indicate public concern about creek armoring because it potentially is a hardscape versus natural solution and because it affects the creek ecosystem. Once the additional riprap has been fully analyzed and plans revised, planning staff will determine what further review would be required. Further, we recommend the addition of riprap or other deviations from approved plans, be discussed with Rancho Carlsbad residents prior to their incorporation into revised plans. 2. Project approvals noted above are set to expire September 13, 2012. As your EA filing notes, you will submit extension requests for these permits this June. 3.
