CDP O0--30- and Mitigated Negative Declaration (see AB 0-(b,24S).
CUP O0.-ZZ(AyCDP O0--30-(A) and CUP O0.-ZZ(A)x0- were for a temporary building which was
destroyed hy the recent Poinsettia Fire.
A community center (meeting rooms, multi-function space, and banquet facilities) is the final element
that was approved for the ZOOO- Aviara Park Master Plan. Based on the recent community needs
assessment, the City Council approved an updated master plan which replaces the community center with
a large passive outdoor community gather space with a small amphitheater and a small community
room. Please see page 4 for a detailed project description.
It is anticipated that an amendment to CUP 03 O-O- and CDP O0.-30- will he required (amendment B).

DESCRIPTION OF PROPOSAL - Describe the project in as much detail as possible. Use as much space as needed. Attach
additional sheets (drawings, etc.) if necessary. Be sure to identify, if applicable, estimated quantities of grading (including
import/export), construction staging areas on and offsite, areas of sensitive vegetation, unique construction technologies,
proposed facility technologies and byproducts, and any public art component. If preliminary or conceptual plans or exhibits
are available, please include two sets with this transmittal.
The project consists of a large passive outdoor community gathering space which replaces the previously
approved community center. The proposed community gathering space includes landscaped areas,
walkways, a small amphitheater, decorative seat walls, fire pit, family picnic areas, and a O-OOO sf.
community room with warming kitchen, and food/beverage service. The project will be located on a
previously graded, vacant portion of the site located near the northwest comer of the Aviara Community
Park.
Mitigation measures identified in the Mitigated Negative Declaration will be incorporated into the project
to avoid potential indirect impacts to sensitive biological resources. Additionally, the project will incorporate
appropriate adjacency standards to reduce potential indirect impacts to sensitive species and habitats as
specified in the Carlsbad HMP. The surrounding habitat area was severely burned during the ZOO-^
Poinsettia Fire.

Thank you for submitting an Early Assessment to construct additional park facilities at Aviara
Park, located at 6435 Ambrosia Lane.
The proposed project includes the following:
• Construct a 1,000 square foot community facility
• Construct an amphitheater, picnic tables with shelters and a fire pit
In response to your application, the Planning Division has prepared this comment letter. Please
note that the purpose of an Early Assessment is to provide you with direction and comments on
the overall concept of your project.
Planning:
Community facility: A 17,768 square foot community facility was previously approved for the
Aviara Community Park IVlaster Plan (MP 177(DD)), and adopted by the City Council at its meeting
on August 6, 2002 (Agenda Bill No. 16,845).
The proposed amphitheater, picnic tables with shelters and 1,000 square foot community facility
would replace the previously approved 17,768 square foot community facility. The facilities
would be located at the northern area ofthe park on a previously graded, vacant portion ofthe
25-acre park.
The previously approved community facility was approved to contain a multi-purpose room,
activity room, meeting room and kitchen along with other accessory uses. The proposed 1,000
square foot community facility would be a similar use and less intensive than the community
facility that was approved; therefore, per Carlsbad Municipal Code (C.M.C.) 21.42.140.100 b. the
proposed community facility would not require an amendment to CUP 01-22.

Amphitheater: The amphitheater was never part of the approved MP, therefore, the
amphitheater will require an amendment to CUP 01-22. Furthermore, an amendment to the
Coastal Development Permit forthe park (CDP 01-31) will be required forthe community facility
and amphitheater structure.
Permits:
• Amendment to CUP 01-22 for the amphitheater
• Amendment to CDP 01-31 for the amphitheater and community facility
Environmental: The Mitigated Negative Declaration (MND), Addendums 1 and 2, and the
Mitigation Monitoring and Reporting Program (MMRP) for Aviara Community Park were
approved by the City Council on August 6, 2002 (Agenda Bill No. 16,845). The proposed
community facility is within the scope of the prior environmental document and no further
environmental documentation is required per CEQA Guideline Sections 15162. However, the
proposed amphitheater may require further environmental review, in particular concerns with
noise and lighting impacts on the surrounding residential neighborhood and Open Space
preserve.
Land Development Engineering;
The project will require the following documents:
• Grading Plans
• Geotechnical Report
• Hydrology Report
• Storm Water Management Plan (SWMP) as necessary
Other;
Consider opportunity to install electric vehicle parking with charging station(s).
