EA 15-05-SUNNY CREEK RIP RAP ENERGY DISSIPATER REPAIR AND SLOPE
RESTORATION
Thank you for submitting an Early Assessment to repair the existing rip rap energy dissipater and failed
slope on the west bank of Agua Hedionda Creek, located on property at 5855 Sunny Creek Road.
The proposed improvements include: 1) repairing the eroded south bank of the creek, adjacent to the
storm drain, by installing rip rap and soil to stabilize and repair the bank; and 2) re-vegetating the restored
section of slope with native plants.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of an Early Assessment is to provide you with direction and comments on the overall concept
of your project. This Early Assessment does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. Since the project is proposed within Agua Hedionda Creek, which is within the 100-year floodplain,
the project will require a Special Use Permit (SUP)-floodplain for any construction or development
within the flood hazard area.
2. If the project proposes any direct or indirect impacts to natural habitat, including any permanent
impacts to riparian habitat, the project may need a Habitat Management Plan (HMP) permit.
3. The proposed project is within Zone 15 of the Proposed Standards Area, as depicted in the City of
Carlsbad's Habitat Management Plan (HMP), dated November, 2004. This corridor is an important
core and linkage habitat for wildlife movement. The Planning Standards states, "Maintain and
enhance the wildlife movement potential between core areas using sensitive design... Conserve all
riparian habitats onsite, and prohibit fill or development within the existing flood plain except where
required for ... essential infrastructure." Please keep these Planning Standards in mind when
designing the project.

4. No trimming of vegetation shall occur between February 15 and September 15 during the bird
breeding season, unless a qualified biologist conducts a focused survey for bird nests not more than
72 hours prior to commencement of vegetation trimming activities. If active nests are found, the
city's contractor shall cease vegetation trimming activities within 500-foot buffer zone around the
nest site, as determined by a qualified biologist, until juveniles have fledged and the nesting cycle is
complete. Furthermore, no activities which would result in noise levels exceeding 60 dBA hourly Leq
within this 500-foot buffer shall be allowed during the bird breeding season.
5. Environmental review for compliance with the California Environmental Quality Act (CEQA} will need
to be performed prior to construction. Based on the location of the project within wetlands, and
within the Agua Hedionda Creek, a Biological Resources Technical Report (BTR} will need to be
prepared for the project. Please review the Guidelines for Biological Studies available on the city's
website. Please submit the BTR with the submittal of a SUP, and possibly an HMP, application.
6. All work, including staging, contractor parking and storage areas, shall be located outside of sensitive
habitat areas and shall be depicted on the plans.
7. The project may require permits from the CDFW, USACE, and RWQCB, respectively, depending on
potential impacts to sensitive habitat and streambed impacts.
