Authority - This permit will be issued or denied under the following authorities: Structures or work in or affecting navigable waters of the United States - Section 10, River and Harbor Act of 1899 (33 U.S.C. 403). Discharge of dredged or fill material Into waters of the United States Section 404, Clean Water Act (33 U.S.C. 1344); 0 Transportation of dredged material for purpose of dumping into ocean waters - Section 103, Marine Protection, Research and Sanctuaries Act of 1972 (33 U.S.C. 1413). Evaluation - Tho decision whether to issue a permit will be based on an evaluation of the probable impact Including cumulative impacts of the proposed activity on the public Interest. That decision will reflect the national concern-for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered Including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion, and accretion, recreation, water supply and conservation, water quality, energy needs, 10 safety, food production and;-in general, the needs and welfare of the people. in addition, if the proposal would discharge dredged or fill material, the evaluation of the activity will include application of the EPA GuldelIn 40 CFA 230) as required by Section 404 'b) (1) of the Clean Water Act. SPLCO-R Public Notice No. 82-180-RA DETAILED DESCRIPTION OF ACTIVITY AND PURPOSE (per applicant): Construct a Lorzgard Tube (with filter cloth and a filter cloth anchor tube) along tthe beach front. Approximately 18,310 cubic yards of fill material will-be imported, of which 3,810 cubic yards will be placed inside the tube and the remaining 14,500 cubic yards will be used as backfill in the Pacific Ocean at City of Carlsbad,-San ­' Diego County, California. .
