1. Comment:
Thank you very much for furnishing to the Water District the
subject draft EIR. We appreciate this opportunity to respond
to the public water system aspects of the development that are
addressed in the report.
First of all, the Costa Real Municipal Water District has
adopted a five-year major facilities program as outlined in
Table 4 (page 9) of the report entitled "Final Report - Costa
Real Municipal Water District - Major Water Facilities - Fin-
ancing Plan and Rate Study ?? dated June, 1983, prepared by Bar-
tie Wells Associates. A copy of this Table 4 is attached for
reference purposes. As an amplification to the statements that
are included in the draft EIR, the Water District master plan
that is currently operative for the development area, as well
as the current update of the master plan for the entire Water
District territory, identifies specific projects that our Board
of Directors has deemed appropriate to proceed with on an im-
mediate basis. There are a total of nine projects listed in
Table 4 (attached), and it should be understood by all parties
that the capability of the Water District to provide pipeline
capacity, reservoir storage capacity and all the other important
features of our entire water system is predicated upon the time-
ly completion of all of the facilities listed therein.

2. Comment:
Implementation of the "Major Water F ac iliti es?? construction pro-
gram requires a companion District-wide financial program to
fund the important projects. As one of several elements of the
financial program, the District has established a new "Major
Facilities Charge" (MFC) effective on August 1, 1983. At that
time, the initial charge for the MFC amounted to $300.00 per
equivalent dwelling unit and based upon a graduated scale of
increases, the MFC will be $880.00 per equivalent dwelling unit
commencing July 1, 1984. The MFC is a basic part of the Dis-
trict's capital facilities financing program.
Response: This comment has been acknowledged. Basedon the max- N
imum development of 516 dwelling units; $454,080.00 would be
collected from the proposed development upon project implementa-
tion.
3. Comment:
S The draft EIR has specific comments with respect to water con-
servation measures. In this context, we believe it is approp-
riate to consider the maximum utilization of reclaimed water for
the subject development. Under a recently approved agreement
between the Costa Real Municipal Water District and the City of
Carlsbad, the reclaimed water service is the responsibility of
the City of Carlsbad. We, therefore, recommend having the
City's input regardihg plans to develop a reclaimed water system
to serve this development.
Response: This comment is acknowledged and is hereby included
as part of the final EIR.
4. Comment:
• We also call to your attention several matters that are referred
to in the draft EIR that require amplification and correction.
The Water District operates an existing 18-inch water main that
traverses the property in an east to west direction and depending
upon the actual location of the new street in the area, it may
become necessary for this pipeline facility to. become relocated.
Additionally, a major transmission main that brings water to this
immediate area is an existing 20-inch line in E1 Camino Real and
the adopted master plan also indicates the need to construct a
• parallel 16-inch water main along the west side of El Camino Real
to bring additional service to this area. The entire project
area is ideally located from the standpoint of substantial trans-
mission facilities so that in addition to the construction of the
local in-tract water system facilities, the implementation of the
five-year program as set forth previously will provide for all
of the water supply needs of the proposed development

COUNTY OF SAN DIEGO
DEPARTMENT OF PUBLIC WORKS
1. Comment:
Palomar Airport is a County owned and operated general aviation
facility located within the City of Carlsbad. The airport is
open 24 hours a day. In 1979 a total of 268,000 take-offs and
landings were completed, making Palomar one of the busiest sin-
gle runway airports in the nation. Current economic conditions
have reduced the number of operations to 200,000, however, we
expect this to increase to 300,000 annual operations within a
few years.
Paraphrasing conclusions found in the Draft EIR on Page 91, third
paragraph:
1. Aircraft typically will not pass over the site.
2. Noise contours found in the airport land use plan are
presented in CNR values.
Both these conclusions are incorrect.
This project lies within the Palomar Airport three-mile Air Traf-
fic Control Zone. The area is now subject to frequent low level
overflight by aircraft and helicopters making both visual and
instrument approaches. There is no practicable means by which
such overflights can be avoided in the future. A number of ac-
tions have been taken to reduce the impact of airport noise in
nearby communities. These include in-flight noise abatement
procedures, as well as restrictions on use of the airport.
The Comprehensive Land Use Plan, dated May 1974, projects that
20% of all air traffic will pass over or in close vicinity to the
site. The CLUP also prbjects the 1990 65-CNEL noise contour in
CNEL values. Additionally, the site underlies a published major
helicopter flight path to the airport.
In recent years as a result of residential growth in the vicinity
of the airport, the County and City have received an increasing
number of complaints over aircraft noise. These complaints gen-
erally come from residents living within five miles from the air -
port. The proposed residential development is in this area.
Based upon recent noise complaint experience at Palomar, the
location is clearly a noise sensitive area. There is no doubt
that the residents will encounter problems of compatibility with
respect to the airport environment. Requirements for residential
sound proofing in the project area can reduce interior noise lev-
els and be of some benefit, but not a solution.
If this development is undertaken it will be of utmost importance
for the impact of airport operations to be clearly identified to
and acknowledged, in writing, by each propective purchaser prior
to the close of escrow. To this objective, airport management
will recommend to the City of Carlsbad that the developers
be required to grant an avigation easement over the property
as a condition for approval of the project.
Response: In order to respond to this comment, Elfend Asso-
ciate s1 contacted Mr. Paul Dunholter, P. E., of Mestre Greve
Associates, who indicated the following:
The subject property is located within an area designated as
clearly to normally acceptable with respect to airport noise
based on the information contained within the County of San
Diego Comprehensive Land Use Plan for Palomar Airport (May 1974).
In particular, the site is located approximately 4,000 feet out-
side the 1990 65-CNEL Noise Contour. The 65-CNEL noise level
is the accepted standard for the assessment of compatible resi-
dential land uses located adjacent to airport facilities. This
standard is recommended by the Federal Aviation Administration,
the State of California Division of Aeronautics, and the Palo-
mar Airport Comprehensive Land Use Plan. Based on this cri-
teria, the existing land use is compatible with the noise
environment. An increase in density on this site would not
violate the standards of the airport land use plan, but would
add residential population to an area on the immediate border
of the restricted area.
An additional issue raised by the airport related to the need
for an avigation easement. Avigation easements are normally
associated with projects located within high noise impact
areas. In such cases, the easement serves to protect the air-
port's liability from impacts associated with excessive aircraft
noise. Based on the information contained in the Comprehensive
Land Use Plan for Palomar Airport, this site would not necessi-
tate such a requirement. Such an easement would be consistent,
however, with the City's desire to officially inform future
residents of the potential of noise impacts.

Thank you very much for furnishing to the Water District the subject
draft EIR. We appreciate this opportunity to respond to the public
water system aspects of the development that are addressed in the
report.
First of all, the Costa Real Municipal Water District has adopted a

this Table 4 is attached for reference purposes. As an amplification

This is in reply to your request of August 23, 1983, for comment relative to
the proposed residential development in the vicinity, of Palomar Airport.

MODEL AVIGATION AND NOISE EASEMENT
WHEREAS, [property owner]1 , hereinafter called Grantor, is the
owner in fee of that certain parcel of land situated in the [City,
County, State] more particularly described and identified in Exhibit A
(legal description of property) attached hereto and made a part hereof,
hereinafter called "PARCEL" and
WHEREAS, E ] hereinafter called Grantee, is the [owner
and/or operator] of certain properties upon which [airport], described
in Exhibit B attached hereto, is located, said properties lying within
[City, County, State] and furthermore being In close proximity to said
PARCEL; and
WHEREAS, Grantor and Grantee wish to establish provisions so that
aircraft usingthe [airport] shall have the right of flight and the
right to cause noise, light, and other effects associated with the
operation of aircraft In the airspace over and above said PARCEL.
NOW, THEREFORE, Grantor, for its heirs, executors, administrators,
successors and assigns, for and in consideration of the sum of One
Dollar ($1.00) and other good and valuable consideration, receipt and
sufficiency of which are hereby acknowledged, hereby grants and conveys
• to Grantee, its successors and assigns forever:
1. A perpetual public-use avigation/noise easement subject to
termination as expressly provided herein, and right-of-way for the
free and unobstructed passage and flight of aircraft, of any and
all kinds now known or hereafter Invented, used or designed for
navigation or flight in the air, of the class, size and category
operationally compatible with [airport]. Said easement shall be
In, through, over and across the airspace of said PARCEL in an
airspace as described and depicted in Exhibit C (map of areas
protected by easement including description of imaginary surfaces
and elevations).
2 The rights herein granted shall Include the right in such airspace
to allow, make and emit such noise, light, vibrations, fumes,
exhaust, smoke, air currents, dust, fuel particles, radio,
television, and other electromagnetic Interferences, and all other
effects as may be Inherent to the operation of aircraft for
navigation or flight In the air.

3. Grantor hereby fully waives, remises and releases any right or

cause of action that It may now have or that it may have In the
future against Grantee, its successors, and assigns, and covenants
not to sue due to such noise, light, vibrations, fumes, exhaust,
smoke, air currents, dust, fuel particles, radio, television, and
other electromagnetic Interferences, and all other effects that may
- be caused or may have been caused by the operation of aircraft
landing at, or taking off from, or operating at or on [airportl.
Said release and covenant shall include, but not be limited to
claims, known or unknown, for damages for physical or emotional
Injuries, discomfort, inconvenience, property damage, death,
• interference with use and enjoyment of property, diminution of
property values, nuisance, or inverse condemnation or for
Injunctive or other extraordinary or equitable relief.
4. It is further agreed that Grantee as (owner and/or operator) of
(airport) shall have no duty to avoid or mitigate such damages by,
without limitation, setting aside or condemning buffer lands,
- rerouting air traffic, erecting sound or other barriers,
establishing curfews, noise or other regulations, except to the
extent, if any, that such actions are validly required by
governmental authority. Grantor reserves such use, rights and
:_-privileges in said PARCEL as may be exercised and enjoyed without
-. Interference with or abridgment of the rights hereby granted.
5. (a) This grant of easement allows the level of aircraft noise
Impinging on Grantor's PARCEL to be the lesser of:
(1) The annual CNEL reflected on the latest map validated by the
(County of ) and filed with the California Department of
Transportation, Division of Aeronautics in accordance with §5050 of
Title 21 of the California Administrative Code, or
(2) The annual CNEL reflected on any subsequent map validated by
the County of ] and filed with the California Department of
Transportation, Division of Aeronautics in accordance with §5050 of
Title 21 of the California Administrative Code.
(b) There is hereby created an irrebutable presumption that this
grant of easement is overburdened by unreasonable use if the noise
which impiiges on the burdened property exceeds the easement by an
'amount equal to or greater than 1.5 dB CNEL, and Grantor may seek
Injunctive relief from the unreasonable use of the easement.
(c) There is hereby created an irrebutable presumption that this
grant of easement Is so overburdened by unreasonable use that its
purpose is defeated if the noise which impinges on the burdened
property exceeds the easement by an amount equal to or greater than
3.0 dB CNEL, and Grantor may seek a court finding that the easement
Is extinguished. -

(d) The provisions of subdivisions (b) or (c) shall not apply under
the following circumstances: (specify exceptions, If desired).

6. This grant of avigatlon/noise easement shall not operate to deprive
the Grantor, his successors or assigns, of any rights that it may
from time to time have against any individual or private operator
for negligent or unlawful operation of aircraft.
7. For and on behalf of Itself, its successors and assigns, Grantor
- hereby covenants with Grantee for the direct benefit of the real
property constituting [airport] that neither Grantor nor Its
• successors in interest or assigns shall hereafter construct or
permit the construction or growth of any structure, tree or other
object that penetrates an approved transitional, horizontal, or
control surface as described and depicted inExhibit C or that
constitjitesan obstruction to air navigation under FAA Part 77, or
that obstructs or interferes with the use of the flight easements
and rights of way herein granted or that creates electrical
interference with radio communication between any installation upon
said airport and aircraft, or as to make it difficult for pilots to
distinguish between airport lights and other lights, or as to
impair visibility In the vicinity of the airport, or as otherwise
to endanger the landing, take-off or maneuvering of aircraft.
Grantee reserves the right to mark and light as obstructions to air
• navigation any such building, structure, tree or other object now
upon, or that in the future may be upon Grantor's property,
together with the right of ingress to, egress from, and passage
over Grantor's property for the above purpose.
8. All promises, covenants, conditions and reservations contained in
this document are made and entered into for the benefit of [owner
and/or operator] of [airport]. These promises, covenants,
conditions and reservations shall run with the PARCEL, described
and identified on Exhibit A attached, and bind Grantor's heirs,
administrators, executors, successors and assigns to the maximum
extent now or hereafter permitted by statute or case law and are
Intended by the parties to comply with California Civil Code §1468.
The real property first hereinabove described as the PARCEL is the
servient tenement and said !airportl is the dominant tenement.
Grantor for itself and its successors and assigns waives all rights
under Civil Code §1542. Successors and assigns" as used in this
paragraph includes without limitation: invitees, licensees,
permittees, tenants, lessees, and others who may use easement
rights reserved herein or use or be upon said PARCEL, and/or their
respective officers, agents, and employees. -
9. Grantor agrees to defend at its own cost, hold harmless and
Indemnify Grantee from any liability for or based upon the exercise
- of the easement rights granted herein. -

NOTICE OF COMPLETION OF DRAFT ENVIRONMENT IMPACT REPORT
NOTICE IS HEREBY GIVEN THAT the city of Carlsbad has prepared a
draft environmental impact report in accordance with the Environmental
Protection Ordinance of 1980 (Ord. 9557) regarding a General Plan Amendment
to increase residential densities and to provide recreational facilities.
The project is generally located in a County island south of Camino Vida
Roble and west of El Camino Real as shown on the location map. The draft
EIR for the Roberts Group is available for public review from August 23,
1983 to October 6, 1983. The original draft EIR is on file with the city
of Carlsbad Land Use Planning Office and Carlsbad Public Library and will
be available for public review and comment until Octiber 6, 1983. All
comments shall be submitted to the Land Use Planning Manager in writing.
