I have told them that it has been approved by Planning Commission (02-02-94) and is contingent upon City Council approval of the Master Plan. The map in effect is approved. If that is true, they are considering an appeal of the approval to the City Council for the reason stated below. Their interest is in having a condition placed on the map requiring the dedication of right- of-way for a mitigated alignment of future Leucadia Boulevard along the southwestern part of the Green Valley site. Brian and I have talked about this and do not believe that it is appropriate for the right-of-way for several reasons. They are: to require 1. Encinitas has not yet approved a project let done a Leucadia alignment. rc 2. We have not assessed or approved a Leucadia alignment. 3. Neither the Encinitas Ranch Specific Plan EIR nor the Green Valley EIR have analyzed the "mitigated8 Leucadia alignment. 4. Requiring the dedication may lead to complications and challenge of the Green Valley EIR in that the project would be changed. 5. If Encinitas should approve the E-ranch Specific Plan with the proposed "mitigated" Leucadia alignment, they can request us to assist in the acquisition of the right-of- way, which we would gladly do. For all of these reasons, I would be inclined to tell them that should go through regular channels and ask simply for our assistance in obtaining right-of-way after they have determined where they want the road. . 8.- CHRISTER WESTMAN Associate Planner C: Brian Hunter 7
