The proposed sphere amendment areas include three incorporated right-of-way areas along Rancho Santa Fe Road totaling approximately 2.77-acres. The subject territory is located north of El Camino Del Norte; east of El Camino Real; south of San Marcos Boulevard; and west of Twin Oaks Valley Road (Thomas Bros., pg. 1128). The sphere amendments are requested to facilitate a reorganization of incorporated right- of-way territory between the Cities of Carlsbad and San Marcos that is intended to create more logical and orderly incorporated boundaries following a previous realignment of Rancho Santa Fe Road. State Law requires that notification of the impending amendment be published in a newspaper serving the area, and that all property owners and registered voters located in the affected territory and within 300 feet of the exterior boundary of the subject property be individually notified. At the hearing, the Commission will hear any person who wishes to speak and will consider the application and report of the Executive Officer. The files may be examined in the LAFCO office. Nos.: SA13-48a; SA13-48b; R013-48 RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO ADOPTING AN AMENDMENT TO THE SPHERES OF INFLUENCE FOR THE CITY OF CARLSBAD AND CITY OF SAN MARCOS AND MAKING DETERMINATIONS, APPROVING, AND ORDERING THE "SAN MARCOS -CARLSBAD REORGANIZATION" (CITY OF SAN MARCOS) On motion of Comm,issioner Pocklington, seconded by Commissioner Horn, the following resolution is adopted: WHEREAS, pursuant to Government Code Section 56425, the San Diego Local Agency Formation Commission is required to develop and determine a sphere of influence for each local governmental agency within the County; and WHEREAS, said Government Code Section 56425 further provides that a sphere of influence, after adoption, shall be used by the Commission as a factor in making regular decisions over which it has jurisdiction; and WHEREAS, the Commission's Sphere of Influence Guidelines provide that the sphere of influence provides guidance in reviewing jurisdictional proposals and promotes efficient provision of organized services; and WHEREAS, the Commission originally adopted the sphere of influence for the City of Carlsbad on June 5, 1978 and affirmed on August 6, 2007; and WHEREAS, the Commission originally adopted the sphere of influence for the City of San Marcos on August 6, 1979 and affirmed on March 3, 2008; and WHEREAS, an application has been made to amend the spheres of influence for the City of Carlsbad and the City of San Marcos; and WHEREAS, a resolution of application was submitted to this Commission for annexation of territory to the City of Carlsbad, the City of San Marcos and the San Marcos· Fire Protection District, with concurrent detachments of specific areas from the San Marcos Fire Protection District; City of Carlsbad, County Service Area No. 83 (San Dieguito Local Parks) and County Service Area No. 107 (Elfin Forest I Harmony Grove Volunteer Fire Department), which resolution was adopted by the City Council of the City of San Marcos as Resolution No. 2011-7475, dated April 12, 2011, pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code; and 1 WHEREAS, the reason for the proposed spheres amendments, involving annexations and detachments is that the City of Carlsbad and the City of San Marcos agreed to exchange territory and to consolidate three separate parcels that would create a more logical boundary of territory between the cities; and WHEREAS, the territory proposed for the sphere amendments and reorganization is as described in the application on file with the Local Agency Formation Commission; and WHEREAS, the Executive Officer of the Commission has filed his report on said sphere amendments and reorganization, which report was received and considered by the Commission; and WHEREAS, pursuant to Government Code Section 56427, the Executive Officer of this Commission set a public hearing on the proposed sphere amendments for November 3, 2014, and gave notice of the date, time, and place of said hearing in accordance with Government Code Sections 56834 and 56835; and WHEREAS, it has been determined that the proposal consists of an annexation or detachment or a reorganization consisting of annexations or detachments, or the formation of a County Service Area. The commission hereby waives protest proceedings because all of the following have occurred: (1) mailed notice has been given to landowners and registered voters within the affected territory; (2) written notice has been given pursuant to Government Codes Sections 56663 and 56157 disclosing that unless written opposition is received before conclusion of commission proceedings, the commission intends on waiving protest proceedings; and (3) the written notice has disclosed that there is the potential for extension or continuation of previously authorized charges, fees, assessments, or taxes. NOW THEREFORE, pursuant to the Cortese/Knox/Hertzberg Local Government Reorganization Act of 2000 (Government Code Section 56000, et seq.), the Local Agency Formation Commission of the County of San Diego does hereby resolve, determine, and order as follows: (1) The sphere amendment hearing was held on the date set therefore, and due notice of said hearing was given in the manner required by law. (2) At that hearing the Commission called for, heard, and considered all interested parties and read and considered the report of the Executive Officer. (3) The Commission, acting as a responsible agency, has considered the environmental effects of the project as shown in the negative declaration. (4) The Commission has considered the factors enumerated in Section 56425 prior to adopting the amendments to the spheres of influence for the Cities. 2 (5) The Commission hereby approves the sphere amendments and reorganization with boundaries as described in Exhibit A attached hereto for the reasons set forth in the Executive Officer's report, waives the conducting authority proceedings pursuant to Government Code Sections 56662 or 56663, and orders the following actions: (a) Annexation of the territory described in Exhibit A to the City of San Marcos. (Area 1A and 1 B) (b) Detachment of the territory described in Exhibit A from the City of Carlsbad and annexation to the City of San Marcos and San Marcos Fire Protection District. (Area 2A and 2C) (c) Detachment of the territory described in Exhibit A from the City of San Marcos and San Marcos Fire Protection District and annexation to the City of Carlsbad. General Plan Amendment (GPA 11-03) consists of a boundary adjustment between the cities of Carlsbad and San Marcos due to widening a section of Rancho Santa Fe (RSF) Road north of the intersection of RSF Road and Melrose Drive to south of La Costa Meadows Drive. The existing bridge over the San Marcos Creek crossing was also replaced a few years ago when the road was realigned. The GPA application only includes the boundary adjustment whereby the City of Carlsbad will detach two parcels to the City of San Marcos and the City of San Marcos will detach one parcel to the City of Carlsbad. The boundary adjustment does not include any construction activities. General Plan Amendment (GPA 11-04) consists of a proposed amendment to changes the time frames, or estimated completion dates, of Program 2.1 of the City of Carlsbad 2005-2010 Housing Element. This program calls for the city to complete, by certain dates, various land use actions (e.g.. General Plan and zoning changes) to meet its Regional Housing Needs Assessment ("adequate sites") requirement. These dates would be revised. The proposed dates are within the current housing cycle, which has been extended to April 2013. The proposed amendment recommends no new land use actions. Implementation of Program 2.1 land use actions are subject to separate, noticed public hearings and would not result in any development. Neither amendment would approve development. Project Description GPA 11-03: The RSF Boundary Adjustment project encompasses a portion of Rancho Santa Fe Road from just north of the street's intersection with Melrose Drive to just south of its intersection with La Costa Meadows Drive (see attachment). GPA 11-03 proposes a General Plan land use designation for an approximately 0.7 acre portion of Rancho Santa Fe Road. This portion of the street is currently in the City of San Marcos and would be detached from that city and annexed to the City of Carlsbad. As the attachment shows, this and other portions of the street and land adjacent to it are proposed either to be detached from or annexed to Carlsbad. The detachments and annexations stem from a 2003 agreement between both cities regarding the realignment of Rancho Santa Fe Road, a project now complete, and the readjustment of the boundary common to both cities to better match the realigned road. The County's Local Agency Formation Commission, which approves municipal boundary adjustments, requires the city proposed to receive the annexed property to give it a General Plan land use designation before the annexation is approved. Carlsbad proposes a land use designation of "Prime Arterial." GPA 11-04: This proposed amendment affects the text ofthe General Plan Housing Element, approved in December 2009. The Housing Element contains programs that help implement the city's plan to provide housing for all economic segments of the community. For example. Program 2.1, "Adequate Sites," identifies land use actions the City will take to make sites available for lower and moderate income housing during the current housing cycle. These actions include amendments to change land use designations and increase allowable densities on the sites. "Sites" include specific properties, such as Quarry Creek and Ponto, and general areas, such as the downtown Village area and adjacent Barrio neighborhood. To comply with a recent court order, the City must amend Program 2.1 to adopt updated time frames for implementation of the actions set forth in the program. Current program timeframes state actions were to have been completed by October 2009 or June 2010. The updated time frames would replace these dates. While not yet determined, the new time frames will fit within the current housing cycle, as extended. The housing cycle has been extended from its original end date of June 2010 to April 2013, consistent with SB 575 and San Diego Association of Governments (SANDAG) action regarding the proposed regional transportation plan. It also proposes no development. Program 2.1, as now adopted, is attached. Time frames that would be replaced are included at the end of the program, under "Objectives and Time Frames," on page 6-8. Cultural Resources Survey GPA 11-03: Because the proposed amendment would result in no development and would result in a land use designation that recognizes an existing improvement (a street), no survey is necessary. GPA 11-04: The proposed amendment would result in no development or land use changes and a survey is not necessary. However, implementation of some ofthe land use actions listed in Program 2.1 may require cultural resources surveys. As the program notes, these actions require additional, separate amendments to the General Plan, Zoning Ordinance, and other land use documents. These amendments also will require environmental review and noticed public hearings. Requested Deadline Pursuant to Government Code §65352.3(a) (2), please respond within 90 days of receipt of this notice in the event your tribe wishes to consult with the City regarding this matter. However, regarding GPA 11-04 in particular, please let us know as soon as possible if you want to consult on this item. The city wants to be as responsive as it can to the court order that requires this general plan amendment and desires to process the amendment through to City Council by the end of July.
