Description/Explanation::
The proposed project is a General Plan Amendment for a Zone Change to the property at 6405 El
Camino Real, Carlsbad CA 92009.
The amendment would change the 2.48 acre property's Planned Industrial (P-M) designation to the
Office (0) designation to allow for the existing 12,763 SF building to be converted from industrial/
commercial offices to dental offices for use by Hulse Orthodontics. The owner would modify the
interior of the structure to be suitable for dental operations. No other modifications to the structure's
architectural features or the property site features are proposed.
As shown in the attached exhibit, the proposed zoning change from P-M to 0 to allow for a dental
use at this property is appropriate because three other medical/wellness office uses are located
in close proximity along the El Camino Real corridor. Additionally, since the project site is located
along the eastern edge of the P-M zoned area, it is an ideal transitional use with other uses along
El Camino Real, including the residenital uses to the southeast.

The project site located at 6405 El Camino Real, Carlsbad CA 92009 is 2-48 acres and has been
developed since 1982. The topography of the built portion of the site is flat with an
approximately 30-foot landscaped embankment along the eastern side of the property.
Access to the site is from Camino Vida Roble. The site contains a one-and two-story 12,763 sf
brick building situated along the northern boundary of the property and is currently used for
industrial/commercial office space. The property contains an 84-space parking lot and is
landscaped with mature ornamental tree and shrub species. The on-site vegetation contains
common bird and animal species associated with non-native vegetation in urban settings. The
existing structure has no historic value and the site does not have scenic qualities.
Additionally, because the project would not include any ground disturbance, there would not
be any chance of encountering potential subsurface cultural resources. The attached photos
1 through 4 depict the current site setting.

El Camino Real borders the project site to the east and Camino Vida Roble is the property's
frontage street to the north. The surrounding properties to the north, west, and south are
occupied by industrial/commercial buildings that contain similar uses as the project site. The
buildings immediately to the north are one-story and buildings to the northwest, west and
south are primarily two-·story structures. To the northeast of the project site across the
intersection of El Camino Real and Camino Vida Roble is the one-story Kingdom Hall of
Jehovah's Witnesses and immediately east across El Camino Real is a vacant lot and Jasper
Road. Approximately 300 feet to the southeast of the project site is a residential community
containing two-and three-story single family homes. Similar to the project site, the
surrounding properties contain ornamental landscaping, common urban animal species, as
well as a lack cultural, historical, and scenic resources. The attached photos 5 through 8 depict
the surrounding land uses.

Time limits on the processin!~ of discretionary projects established by state law do not start until a
project application is deemed complete by the City. The City has 30 calendar days from the date of
application submittal to determine whether an application is complete or incomplete. Within 30 days of
submittal of this application you will receive a letter stating whether this application is complete or
incomplete. If it is incomplete, the letter will state what is needed to make this application complete.
When the application is complete, the processing period will start upon the date of the completion letter.

Proposed Minor Subdivision No.:
Subdivision Map Act (SMA) Section 66452.1 sets a 50-day time limit for the Planning Division to process
tentative parcel maps. Per SMA Section 66451.1, this time limit may be extended by mutual consent of the
applicant and the city to allow for C(:>ncurrent processing of related approvals or an environmental review of the
project.
By accepting applications for tentative parcel maps concurrently with applications for other approvals that are
prerequisites to the map (e.g., Environmental Information Form, Environmental Impact Report, Condominium
Permit, Planned Unit Development]!, the 50-day time limit is often exceeded. For the city to process a tentative
parcel map application concurrently, the property owner or applicant must sign this agreement. If this
agreement is not signed, the city will accept the tentative parcel map application only after all prerequisites to
the map have been processed and approved.

Subdivision Map Act Section 66427.11
(a) The legislative body shall not approve a final map for a subdivision to be created from the conversion of residential real
property into a condominium project, a community apartment project, or a stock cooperative project, unless it finds as follows:
(1) Each tenant of the proposed condominium, community apartment project, or stock cooperative project, and each person
applying for the rental of a unit in the residential real property, has received or will have received all applicable notices and
rights now or hereafter required by this chapter or Chapter 3 (commencing with Section 66451).
(2) Each of the tenants of the proposed condominium, community apartment project, or stock cooperative project has
received or will receive each of the following notices:
(A) Written notification, pursuant to Section 66452.9, of intention to convert, provided at least 60 days prior to the filing of a
tentative map pursuant to Section 66452.
(B) Ten days' written notification that an application for a public report will be, or has been, submitted to the Department of
Real Estate, that the period for each tenant's right to purchase begins with the issuance of the final public report, and that the
report will be available on request.
(C) Written notification that the subdivider has received the public report from the Department of Real Estate. This notice
shall be provided within five days after the date that the subdivider receives the public report from the Department of Real
Estate.
(D) Written notification within 10 days after approval of a final map for the proposed conversion.
(E) One hundred eighty days' written notice of intention to convert, provided prior to termination of tenancy due to the
conversion or proposed conversion pursuant to Section 66452.11, but not before the local authority has approved a tentative
map for the conversion. The notice given pursuant to this paragraph shall not alter or abridge the rights or obligations of the
parties in performance of their covenants, including, but not limited to, the provision of services, payment of rent, or the
obligations imposed by Sections 1941, 1941.1, and 1941.2 of the Civil Code.
(F) Notice of an exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions
that the unit will be initially offered to the general public or terms more favorable to the tenant. The exclusive right to purchase
shall commence on the date the subdivision public report is issued, as provided in Section 11018.2 of the Business and
Professions Code, and shall run for a period of not less than 90 days, unless the tenant gives prior written notice of his or her
intention not to exercise the right
(b) The written notices to tenants reqtJired by subparagraphs (A) and (B) of paragraph (2) of subdivision (a) shall be deemed
satisfied if those notices comply with the legal requirements for service by mail.
(c) This section shall not diminish, limit or expand, other than as provided in this section, the authority of any city, county, or
city and county to approve or disapprove condominium projects.
(d) If a rental agreement was negotiated in Spanish, Chinese, Tagalog, Vietnamese, or Korean, all required written notices
regarding the conversion of residential real property into a condominium project, a community apartment project, or a stock
cooperative project shall be issued in that language.

Based on the San Diego Association of Governments' (SANDAG) Guide of Vehicular Traffic
Generation Rates for the San Diego Region, the project site land use is classified
"Industrial/Business Park" (commercial included). This land use is assigned an estimated
weekday vehicle trip generation rate of 16/1ooo sq. ft. As shown in the calculations provided
below, the current estimated trip generation rate is 204.
The proposed zone <Change would allow for the proposed dental office to operate at the
project site. SANDAG assigns the "Medical-Dental" land use designation an estimated
weekday vehicle trip generation rate of 50/1000 sq. ft. As shown in the calculations provided
below, the estimated trip generation rate for the proposed land use would be 638, resulting
in an increase in 434 estimated weekday vehicle trips. Therefore, no Circulation Impact
Analysis is required for this application.
