HomeMy WebLinkAboutHDP 01-06; St. Amour Residence; Hillside Development Permit (HDP)- City of Carlsbad June 6,2001 Mr. Don Grover Don Grover Architects 2187 Newcastle Ave, Suite 100 Cardiff by the Sea CA 92007 SUBJECT: HDP 01-06 -ST AMOUR RESIDENCE The City has completed a review of the application for a Hillside Development Permit for the development of a single family residence on Lot 264 of Carlsbad Tract 85-35, generally located on the east side of Aviara Drive, between Black Rail Road and Batiquitos Drive. The proposed development of two retaining walls on an uphill perimeter slope, one at the toe of slope and one near the top of slope, has been reviewed for modifications to the development standards of the Hillside Development Ordinance pursuant to Section 21.95.140 of the Carlsbad Zoning Ordinance. It is the Planning Director's determination that the project is consistent with the City's Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and therefore approves this request based on the following: Findinas: I. Hillside conditions have been properly identified on the constraints map which show existing and proposed conditions and slope percentages. 2. Undevelopable areas of the project, i.e. natural slopes over 40% and over 15 feet in height, have been properly identified on the constraints map. 3. The buildable pad of the subject lot is significantly smaller in area, being constrained by manufactured slopes, in comparison to other lots within the same subdivision. 4. The development proposal is consistent with the intent, purpose and requirements of the Hillside Ordinance (Chapter 21.95 of the Zoning Ordinance) in that without the proposed uphill retaining wall, the buildable area of the lot is constrained such that strict adherence to the provisions of the Hillside Ordinance would preclude a reasonable use of a legal parcel which includes hillside conditions as regulated by Chapter 21.95 of the Zoning Ordinance. 1635 Faraday Avenue Carlsbad, CA 92008-7314 (760) 602-4600 FAX (760) 602-8559 www.ci.carlsbad.ca.us @ HDP 01 -06 - ST r . .#OUR RESIDENCE May 22,2001 5. The proposed grading and development will not occur in the undevelopable portions of the site. 6. The grading design minimizes disturbance of hillside lands to the greatest extent possible while providing reasonable development on the legal parcel. 7. The project design substantially conforms to the intent of the concept illustrated in the Hillside Development Guidelines Manual. 8. The proposed modification to the hillside development standards results in manufactured slopes that are more aesthetically appealing by lowering the elevation of the slope with respect to views from public lands and providing landscaping opportunities at the top of slope and on the newly manufactured slope. Conditions: 1, Approval is granted for HDP 01-06, as shown on Exhibits ā€œA - ā€œEā€, dated May 22, 2001, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown on the approved exhibits. Any proposed grading and/or development substantially different from this approval as determined by the Planning Director, shall require an amendment to this Hillside Development Permit.
