the south, towards the upper reach of Encinitas Creek. The
northerly portion of the site has mai-mads fill slopes oa it
from Santa Fe Knolls Unit No. 2, CT 75-9(B).

23. The slope analysis prepared in conjunction with the hillside
development permit shows some slopes in excess of 25% being
in the area of proposed excavation. The alignment and grade
of the sewer line was established in cooperation with the
San Dieguito High School District and their proposed plans
for the development of the High School facilities. The
slopes shown on the grading plans along the north and east
sides of the sewer line are portions of the ultimate slopes
to be constructed by the High School project.
24. During grading operations there will be an increase in noise
levels due to the construction equipment. This will be tem-
porary and end when the construction is completed.
25. Grading operations usually create some amount of dust. This
can be controlled through proper use of water applied to the
areas under construction.
26. The High School site in composed of approximately 80+ acres.
The cut slopes generated by the proposed grading will
ultimately become part of the High School site when it is
constructed.
II. STATEMENT OF NON-SIGNIFICANT ENVIRONMENTAL EFFECTS

I but you think the activity will have no significant environmental
effects, indicate your reasons below:
The installation of the sewer line will remedy an existing
health problem. The homes served by the proposed sewer line
currently have failing septic systems. The cut slopes generated
by the construction will ultimately become part of the. High
School site grading. The constraints required by L.C.W.D. for
•depth of the sewer line and width of access necessitates the
grading shown.

NEGATIVE DECLARATION
PROJECT ADDRESS/LOCATION: On vacant land south of Mission Estancia in the City
of Carlsbad, and west of Wishbone Way in the City of Encinitas.
PROJECT DESCRIPTION: A Sewer Line and Associated Grading.
The City of Carlsbad has conducted an environmental review of the above described
project pursuant to the Guidelines for Implementation of the California
Environmental Quality Act and the Environmental Protection Ordinance of the City
of Carlsbad. As a result of said review, a Negative Declaration (declaration
that the project will not have a significant impact on the environment) is hereby
issued for the subject project. Justification for this action is on file in the
Planning Department.
A copy of the Negative Declaration with supportive documents is on file in the
Planning Department, 2075 Las Palmas Drive, Carlsbad, California 92009. Comments
from the public are invited. Please submit comments in writing to the Planning
Department within ten (10) days of date of issuance.

The project (HDP 89-12) is a sewer line and associated grading. As
proposed, the project will regrade and revegetate to conform to the
surrounding natural hillsides. Interim project specific impacts such
as dust or noise shall be controlled to a level of insignificance.

IV. DETERMINATION (To Be Completed By The Planning Department)
On the basis of this initial evaluation:
X I find the proposed project COULD NOT have a significant effect on
the environment, and a NEGATIVE DECLARATION will be prepared.
I find that although the proposed project could have a significant
effect on the environment, there will not be a significant effect in
this case because the mitigation measures described on an attached
sheet have been added to the project. A Conditional Negative
Declaration will be proposed.
I find the proposed project MAY have a significant effect on the
environment, and an ENVIRONMENTAL IMPACT REPORT is required.

This letter is to inform you that you are in violation of several City and State
codes for the work being done on the Leucadia County Water District Plan No. 201-
86 for the Brown-Daniels sewerline extension.
Our inspector has ordered the contractor to stop all work until the appropriate
permits are obtained from the City of Carlsbad. You are also advised to take
whatever steps necessary to stop all work within the City of Carlsbad.
The particular Code Sections that this work is violating is as follows:
1. Under the Excavation and Grading Sections 11.06.030, 11.06.035, 11.06.050.,
11.06.060., 11.06.100 or 11.06.105, 11.06.180, 11.06.210
2. Under the Hillside Development regulations Sections 21.95.030 and 060 and
also the California Environmental Quality Act.
