A) Phasing the development is not applicable to construction of a rear yard swimming pool. B) The size of the rear yard is a limiting factor and location of the pool to the level portion of the site would place it closer to adjoining property lines and a greater distance from the dwelling unit. C) The rear yard pool is an appropriate scale for the size of rear yard. D) The site already contains a dwelling unit and a swimming pool would be considered a compatible and acceptable use. E) The proposed project is consistent with development occurring in the vicinity. F) Alternative site for the swimming pool is not a viable alternative because the use is consistent with the site. G) The no project alternative would deny the property owner reasonable use of the site. -6- YES MAYBE NO 22. Mandatory findings of significance - a. DISCUSSION OF ENVIRONMENTAL EVALUATION The proposed project consists of approximately 20 cubic yards of grading in addition to the importation of approximately 280 cubic yards of fill for the development of a swimming pool in the rear yard of an existing single family residence. The project site and surrounding neighborhood was previously disturbed when the area was graded to accommodate streets and the existing dwelling units. The site contains non-native vegetation and manufactured slopes that were created when the building pad was originally graded. -7- DISCUSSION OF ENVIRONMENTAL EVALUATION (Continued) Due to the fact that the area has already been altered and the amount of grading to accommodate the pool is minimal, the project will not have any significant environmental impact. The site is located in Local Facilities Management Plan Zone 6 and the approved Zone Plan 6 has guaranteed the adequacy of public facilities for proposed development within the zone. -8- IV. DETERMINATION (To Be Completed By The Planning Department) On the basis of this initial evaluation: _I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. _I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A Conditional Negative Declaration will be proposed. _I find the proposed project MAY have a significant effect on the environment, and an ENVIRONMENTAL IMPACT REPORT is required.
