Description/Explanation.
A City conditional use permit is required for shared
parking allowance. Shared parking allowance for Hotel
Sports Center, Restaurants and Clubhouse. Planning ,
Areas 1, 2, 10 and 11.

Re: Aviara Resort -Non-Residential PUD Application Fee
Dear Ray:
We have recently been informed that yet another application is reqUired for processing
the Aviara Resort devdopment modifications through the Planning Department.' The
fee for this Non-residential PUD application.is an additional $6,000.00.
As has been mentioned, Aviara does not object to funding .legitimate City staff review of
our development proposals in accordance with ordinance requirements. We are finding,. "
however, that redundant fees are now being assessed for identical reviews with
increasing frequency. As you recall, this iSsue was also the subject of our lune 28 letter
of appeal of the redundant LCP amendment fee. '
Aviara'Resort Associates hereby appeals the redundant Non-residential PUD fee, and
asks that this fee also-be waived. We have reviewed the Zoning Chapter 21.47 (Non-
residential Planned Development) and can find no aspect of this chapter which woul,d
, .. requir.e, specific work task or review beyond that already reviewed as part of the
tentative subdivision map or site, development permits which fees have already:been
paid, and whi~~ 'are, presently in the--City process. '
Again, state Taw requires that a direct nexus exist betWeen -municipal fees 'charged and ,
costs incurred. We do not believe that the payment of the Non-residential PUD fee
relates, even remotely, to staff costs that would be expected to be incurred.

This letter accompanies our resubmittal of the above referenced Master Plan
Amendment package. As we discussed by telephone, you have requested only two sets
of each drawing we are resubmitting for the time being. Upon your determination that
ARA has resolved all the issues identified in your letters dated July 12 and July 26,
1995, staff will ask ARA to submit the complete multi-set package that will carry us
through the hearing process.
For simplicity, we will follow the same format in this transmittal as in the above
referenced letters. Enclosed is the following:

Description
An application for amendment to CUP 90-05 with
application fee of $935.00. Note that we have not
filed for a non-residential PUD amendment for
reasons stated previously. We have included a copy of
a letter dated July 27, 1995, to the City Manager
regarding our objection to this fee.
An application for a Hillside Development Permit
with application fee of $400.00. Five (5) copies of a
constraints map/slope analysis by Nolte & Associates
(delivered directly to the City by Nolte under separate
cover).
