PRELIMINARY REVIEW
Engineering Department staff have completed a preliminary review of the above referenced
project. Upon formal application submittal the following engineering items of concern must
be adequately addressed:
1. Please show any and all easements and encumbrances in accordance with
Schedule "B" of a recent Preliminary Title Report (PR) (a PR issued within six
months of formal application submittal) on the site plan. Indicate the future
disposition of any easements and encumbrances.

SUBJECT: MAIATICO RESIDENCE - HDP 95-16
The City has completed a review of the subject application for a Hillside Development
Permit for the construction of a second story deck.
It is the Planning Director's determination that the project is consistent with the City's
Hillside Development Ordinance, Chapter 21.95 of the Carlsbad Municipal Code and
therefore APPROVES this request based on the following;
Findings:
1. Hillside conditions have been properly identified on the constraints map which
show existing and proposed conditions and slope percentages.
2. Undevelopable areas of the project, i.e. slopes over 40%, have been properly
identified on the constraints map.
3. The development proposal is consistent with the intent, purpose, and
requirements of the Hillside Ordinance, Chapter 21.95, of the Carlsbad Municipal
Code.
4. Areas in which topographic change is less than fifteen feet in height and less
than four thousand square feet in area, which are not a part of the
surrounding generalized slope have been identified as required by the
Hillside Development Ordinance, Chapter21.95.090 ofthe Zoning Ordinance.
The deck will extend over a 10' high, 45% manufactured slope that has been
previously altered by building coverage consisting of a multi-level structure
and is no longer a part of a generalized slope. These topographic areas are
therefore excluded from the requirements of the Hillside Development
Ordinance.
