SUBJECT: HDP 96-06 - WILSON RESIDENCE
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Hillside Development Permit, application no. HDP
96-06, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of
items must be submitted directlv to Your staff planner bv amointment. All list
items must be submitted simultaneouslv and a CODV of this list must be included
with vour submittals. No processing of your application can occur until the
application is determined to be complete. The second list is issues of concern to
staff. When all required materials are submitted the City has 30 days to make a
determination of completeness. If the application is determined to be complete,
processing for a decision on the application will be initiated. In addition, please
note that you have six months from the date the application was initiallv filed, July
1 1 and July 19, 1996, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials
necessary to determine your application complete shall be deemed to constitute
withdrawal of the application. If an application is withdrawn or deemed withdrawn,
a new application must be submitted to process the permit.

Please provide a roof plan to assist in accurate building height
measurements.
Please provide the missing wall height information indicated on the enclosed
checkprint.
According to the attached submittal checklist, the slope analysis is supposed
to be drawn to the same scale as the site plan and should include the
following information: location, slope and width of driveway, building
setbacks, location of any retaining walls and drainage systems.
Slope profiles are supposed to be drawn in accordance with section
21.95.020(b) of the Carlsbad Municipal Code, copy attached. The slope
profiles need to be straight cross section lines, two parallel and one roughly
perpendicular. The cross sections must show existing and proposed
topography, structures and improvements and be drawn in the areas of most
intense development.
Please provide the area extent of grading and proposed volumes of cut and
fill, indicating if import or export of material. is required.
Please submit a profile for the proposed 24% grade driveway.
Please label the block wall along the northern property line as ‘existing’.
ISSUES OF CONCERN
Planning:
1. Based upon the building elevations, cross sections and proposed grading
scheme, it appears that the proposed house is well over 30 feet in height and
contains three stories. The maximum building height in the R-1-15 zone is
30 feet with two stories maximum. Enclosed are the applicable portions of
the Zoning Ordinance. Please either redesign the house or show how the
house height complies with the zoning requirements.
2. According to the Zoning Ordinance, the maximum wall height in the front
yard is three and one half (3.5) feet and in the side yard is six (6) feet. The
proposed grading scheme shows walls exceeding these maximums. Please
also note that the infill grading regulations might further limit the wall height.
There is also a design issue with the up to nine (9) foot high exposed
retaining wall on the lower end of the project. Please lower walls to conform
with these provisions.

3. Areas with inclination greater than 40% are considered undevelopable. The
lower end of the proposed house and yard encroach into slopes over 40%
inclination. Please retract development from these areas.
4. No comments on the conformity of grading volumes per developed acre can
be made since no grading volumes were provided. The maximum volume of
grading is 8,000 cubic yards per developed acre.
Engineering:
1. The proposed project is insensitive to infill grading as identified in section
1 1.06.032 of the Carlsbad Municipal Code, copy attached.
2. The proposed 24% grade driveway is considered too steep. A maximum
grade of 15% is allowed by City Standards.
3. Drainage from top of slope and generally onsite has not been addressed.
4. Based upon initial evaluation, a grading permit will likely be needed. A
grading permit may be processed concurrently with the Hillside Development
Permit however, since the site design may change through the Hillside
Development review, you may risk having to re-engineering the grading
construction drawings.
