The Planning Department has reviewed your, application no. HDP 96-1 0, as to its completeness The application is complete, as submitted. Although the initial processing of your application may have already begun, the technical acceptance date is acknowledged by the date of this communication. The City may, in the course of processing the application, request that you clarify, amplify, correct, or otherwise, supplement the basic information required for the application. In addition, you should also be aware that various design issues may exist. These issues must be addressed before this application can be scheduled for a hearing. The Planning Department will begin processing your application as of the date of this communication. HDP 96-10 - CADE RESIDENCE Planning: 1. 2. 3. 4. 5. The Planning Department has identified evidence of cultural resources (archaeological artifacts) located onsite. Please submit a cultural resource survey in accordance with the City's Cultural Resource Guidelines (attached) within 30 days which verifies Sowards & Brown Engineering's determination (Environmental Impact Assessment) that this project will have "no impact" on archaeological resources. If significant resources are identified, the report must include recommended mitigation measures and these measures will be required as part of a mitigated negative declaration. Without this survey, a determination of a potentially significant impact must be made which would require the preparation and certification of an Environmental Impact Report. Grades shown along the southern portion of the site in which landscape berms have been created must be shown on the map as proposed grading and the removal of coastal sage which occurred must be identified and mitigated. As previously requested, the biological analysis must be amended to account for any coastal sage removed as a result of this grading. This analysis must be received within 30 days of this notice to avoid a determination of a potentially significant impact. The proposed grading design will encroach into 40% slopes which is prohibited by the Hillside Development Ordinance (Sections 21.95.030(4) and 21.53.230 of the Zoning Ordinance.) Please pull the grading proposed within the steep slopes back to a point where slopes exceeding 40% are not disturbed. Also, the Agua Hedionda LCP includes provisions restricting development within 25% slope. Consultation with Coastal staff is advised. The Agua Hedionda Local Coastal Program requires lateral access along the shoreline within a 25' wide access easement located landward of the mean high tide line. Without provision for this access easement the project will be denied. Please show the location of this easement on the Tentative Parcel Map and note that an irrevocable offer of dedication for this 25' wide access easement will be recorded. Development of homes on the proposed lots will require an amendment to the Hillside Development Permit, HDP 96-10. Prior to the issuance of building permits for future residential structures, the HDP will be conditioned to require' an amendment for the purpose of reviewing building placement and architecture. Conditions will be included requiring that future structures on these lots comply with Agua Hedionda LCP provisions for development located within 100' of an access easement and/or between a roadway and the shoreline.
