Re: Taylor Made Golf Test Facility
Dear Gary,
In response to your request for verification of the use and safety of
the test range, I offer the following.
There is very little probability that any golf balls will escape the test
range and enter either College Boulevard or Salk Avenue. We can
state this with some assurance based on the test data we have
accumulated over time and the field testing done at the site itself.
Please refer to Mr. Todd Borjesson's memo (attached) of December
19,1996. This memo describes the conditions that helped us design
the site and the conditions in which we intend to operate the test
facility.
This facility will not be used for recreational purposes or for public
use, it is a test facility to be used for research purposes by qualified
test personnel. The testing of golf products will be confined to
daylight hours, as there are no plans to provide lighting for night
testing.
In the event that for an unforeseen reason, a golf ball did manage to
escape the range and cause damage to public property, or in Taylor
Made's view the risk of such an event is greater than anticipated,
Taylor Made Golf may request additional restraint devices/measures
such as fencing or nets be provided to prevent any
reoccurrence/opportunity for damage. Further, we will work in good
faith with the City of Carlsbad and the Research Park to assure that
the solution is also esthetically acceptable.
Taylor Made Golf accepts all liability for personal injury and
property damage resulting from the use of the facility. We are
adequately insured for such events and would provide a certificate
of insurance to the City Of Carlsbad should they require one for the
files.
