No. 5907 Reorder: Call Toll-Free 1-800-876-6827 Version 1 June 1998 COVENANTS, CONDITIONS AND RESTRICTIONS (CC&R's) Harrison Street Minor Subdivision - 97-15 These CC&R's have been established in order to create and maintain the highest property value in our minor subdivision on Harrison Street by: .Preserving the natural beauty of the property *Maintaining the appearance of the building structures .Maintaining the appearance of common areas including the common driveway and adjacent landscaping I. 11. 111. IV. SINGLE FAMILY RESIDENCE This phrase means that the properties are intended for residential purposes and as single family housing units. PREVENTION OF NUISANCE No noxious or offensive activity shall be carried odupon either property, nor shall anything be done thereon which may be or may become an annoyance or nuisance to either owner. Examples might include barking dogs, noisy parties, messy yards stacked with garbage and hobbies that create odor and/or sound problems. APPROVAL OF BUILDING PLANS & PAINT COLORS A. No building or accessory building, retaining wall or fence may be constructed without the written approval of the neighbor. Submit building plans to the neighbor for approval before the start of construction. B . As for painting the exterior of the house, all color choices must be cleared with the neighbor prior to painting in order to ensure aesthetic harmony in our neighborhood. COMMON DRIVEWAY & LANDSCAPE AREAS A. All cultivation, irrigation, maintenance, and improvements (pavement and drainage) of the common driveway and landscape areas (defined in Attachment A) shall be an equally shared expense and responsibility of both residences (owners). B . The driveway shall be accessible to both residences at all times. C . Any damage caused by accident or by deliberate action by the owners or owners' guest(s) will be the responsibility of that owner. Any severe damage posing a safety or health concern must be repaired as soon as possible, no later than 30 days, with the written permission and notification of both residences. 1 LANDSCAPING V. VI. VII. A. Front and back yard landscaping shall be installed and completed by owner within six months of occupancy. B. Each owner shall keep all shrubs, trees, grass and plantings of every kind on his property neatly trimmed, properly cultivated, and free of trash, weeds and all other unsightly materials. FENCES There are various restrictions on fencing regarding both the front and back of the lots. Please reference the City of Carlsbad Rules & Regulations and the California Coastal Commission on this subject. PRESERVATION OF VIEW No tree, shrubbery or other obstruction of any kind shall be planted, erected or maintained on any lot in such a manner as to unreasonably obstruct or interfere with the view obtainable from the other owner. VIII. ANTENNA No external antenna, satellite dish or any structure to be used for the purpose of transmitting or receiving radio, television or related signals shall be installed or constructed on either property so as to be visible from the other property or from Harrison Street. IX. X. XI. ANIMALS Dogs and cats may be kept in reasonable number, usually defined as two of each, but cannot be raised commercially. Other domestic pets are acceptable providing that high standards of care are maintained, to include proper containment on one’s property and cleanliness. TRAILERS No trailer may be kept in the driveway or in front on the homes for more than thirty-six hours. BOATS, CAMPERS, STORED VEHICLES A. No objects such as boats, unmounted campers, trailers, motor homes or inoperable, unregistered, unmaintained vehicles may be placed, maintained or stored on the shared driveway andlor in front of the homes facing Harrison Street. B . No vehicle may be parked on any lawn or unpaved area adjacent to the shared driveway. Permanent RV hookupslpads are acceptable only on the side of garages facing Harrison Street. 2 XII. WORKING ON CARS - EXCESSIVE REPAIRS It is against the provisions of these CC&Rs to work on cars on the shared driveway. Minor repairs on one's own vehicle are usually overlooked. In addition, working on cars as a hobby is allowed only within one's garage or with special written consent from the neighbor. XIII. POLLUTANT ELIMINATION The owners shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit: A. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. B . Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. XIV. SIGNS No signs may be placed on any lot except "For Sale" or "For Rent" signs of reasonable size. Other exceptions may be made with special written consent of the neighbor. XV. DISPUTES OF CC&R'S Should any dispute arise regarding the provisions of the CC&R' s that cannot be settled by both parties, an arbitrator (agreed upon by both parties) shall be contracted to settle said dispute. The owners of the properties of the Harrison Street minor subdivision have read and agreed to the provisions of the CC&R's as outlined above.
