Dear Michael:
We are disappointed to hear that the Coastal Commission Staff is recommending that the
City request a delay of the Carlsbad LCP Amendment #1 batching. We understand that
Coastal Staff is requesting this delay so that they and the City have additional time to
reach some agreement on open space policy wording for all fuhue zone'changes
involving L-C zoned properties. I am informed that Coastal Staff believes that once the
agreement on open space policy is reached, that the City zone change approvals will then
include this policy, and the Coastal Commission use of "suggested modificationstt will
not be necessary. They point out that their position on the policy agreement will be
based upon the Roesch LCP amendment approved with suggested modifications last year.
While we encourage the City and the Coastal Staff to resolve their policy differences on
these zone change matters so that Coastal Commission ratification of City zone changes
will be more routine, we don't see how this resolution will affect the process of the
Carlsbad Promenade LCP amendment. Carlsbad Promenade has already been approved
by the City, and considering the present policy differences, will undoubtedly necessitate
"suggested modifications" whether or not the amendment is delayed a month.
In fact we have reviewed the Roesch suggested modifications and have informed Coastal
Staff that we would concur with their inclusion as suggested modifications on Carlsbad
Promenade. We see no reason why this could not be done at the June hearing.
Nonetheless, Coastal Staff has indicated to us that they are strongly recommending a
delay of the Carlsbad Promenade amendment to the July hearing for the reasons stated,
and that they are confident that the delay will not be extend beyond July.
Under these circumstances, in the spirit of cooperation, my client is supportive of a delay
of the Carlsbad Promenade LCP amendment until the July hearing. We would strongly
object to a further delay that would move the hearing to northern California, or to months
beyond.
