The proposed modifications do not cause any substantive changes the Promenade project as the
requested buffers are all with the open space lot, however the modification requirement that the language
be placed on the LCP Zoning map would require the project to have additional Legislative hearings. A
simpler and probably more effective condition would to have the text included into the open space
easement language on the Final Map. This would disclose the information on the map as well as on any
title report prepared for the property. The project already has been conditioned to place the property in
open space (Condition No. 27, 28 and 29 of PC Resolution 5137 and Condition 26 discusses the
placement of Open Space restrictions in the CC&Rs (which could be modified to include this text as well,
if desired)) and requires permission by the City and Coastal Commission to do any thing in the open
space area.
The City proposes the following condition:
The Developer shall include the following language to the open space easement dedication on the final
map:
Uses within the open space lots 34, 35, 36, 37, and 38 are restricted to habitat conservation, with
the exception to Zone 3 brush management for fire protection, which may be placed in the habitat buffer
area to a maximum of 20 feet. No structures or non-native plantings shall be placed in the habitat buffer
area. Any subsequent modifications to the herein approved open space uses will require a Coastal
Development Permit Amendment by the Coastal Commission.
