Specifically, I wish to address the comment made at the close of the letter regarding Vigilucci’s Seafood and the lack of a Coastal Development Permit (CDP) for the approved outdoor dining. The City’s decision to not require a CDP was deliberate because the approved outdoor dining, as conditioned, does not represent an intensification of the existing restaurant use. The outdoor dining does not intensify the existing restaurant because: o Its approved location is an existing outdoor patio. No changes to the building or site are needed to accommodate outdoor dining. A condition fixes the area in which outdoor dining may occur. o It will add no additional tables or chairs. Instead, Vigilucci’s will move tables and chairs from inside the restaurant to the patio when outdoor dining is desired. Once tables and chairs are moved outside, they will not be replaced by additional tables and chairs inside. A condition (1) limits the restaurant’s maximum number of seats, whether inside or outside and (2) requires a floor plan (already submitted) showing how the maximum number of seats will be placed both inside and on the patio. For your information, the approved maximum number of seats - 125 - is the same as that established years ago when Vigilucci’s was the Sandbar. o It will not increase parking. Since outdoor dining will not add to existing seating, it will not intensify parking demand. u The existing patio will be used only for dining. entertainment. A condition prohibits any outdoor Furthermore, the City will monitor the operations of Vigilucci’s Seafood to ensure compliance with conditions. The restaurant’s approved conditional use permit (CUP) is subject to a special Planning Commission public hearing review this fall and an annual staff review thereafter.
