The Commission found that if the City modified the project, to bring it into conformity with the conditions, it would be consistent with the California Coastal Management Program. The enclosed findings for the Commission’s approval of the City of Carlsbad’s Major Local Coastal Program Amendment (LCPA) #I -03B and Consistency Certification CC-007-03 describes these conditions and the basis for the Commission’s action. Please inform us if you intend to modify this project as conditioned. If you do not accept these conditions, the City and the Fish and Wildlife Service (federally permitting agency) should treat the Commission’s conditional concurrence as an objection (I 5 CFR § 930.4). Additionally, since the Commission’s conditional concurrence may result in an objection (if the City does not accept the conditions), the City has a right to appeal the Commission’s action to the Secretary of Commerce. Pursuant to 15 CFR part 930, Subpart HI and within 30 days from receipt of this letter, you may request that the Secretary of Commerce override this objection. In order to grant an override request, the Secretary must find that the activity is consistent with the objectives or purposes of the Coastal Zone Management Act, or is necessary in the interest of national security. A copy of the request and supporting information must be sent to the California management program and the federal permitting or licensing agency.
