We understand the withdrawal and resubmittal of the application is necessary to avoid provisions of the Government Code which establish strict time limits on the City's authority to act on a project. Per your letter, if the application is not withdrawn, the City would have no choice but to recommend denial of the applicant's request. This position leaves the applicant with no alternative but to withdraw the application. Since your letter also indicated that a 70 percent refund of the original fees paid is allowed, please consider this letter also as a formal request for that refund. Although we would like to resubmit the applications immediately, a delay of a few days is anticipated for the applicant to draw the new fee check. We understand that this minor lapse will not affect the processing of the applications. With the submittal of the new fees and the other information specified in your letter, we anderstand diat the appiications wili be deemed complete without delay.
