This letter is drafted in response to your November 20, 1995 letter in which
you summarize your understanding of Commission staff's position on the
processing of the current amendment to the Aviara Master Plan and the Mello I
and East Batiqui tos Local Coastal Programs regarding the above. While we
generally agree on your characterization of the meeting, a few points must be clarified. First, to simplify the Commission's review of Local Coastal Program Amendment #3-95 (LCPA), we agreed that discussion of the resort elements in the LCPA report would be separated from discussion of non-resort amendments to the Aviara Master Plan in the report (i.e., Parts A, 6 and C). We stated that, as long as the amendment components are not interdependent, the Commission's action can address each item separately and thus not encumber each other. For example, if the Commission adopts suggested modifications for one element, which is distinct from others and there is no interrelationship with other elements, the Commission's action on the others, for which no revisions were adopted, could be final and effective. We did not, as you characterize, agree to separate the different elements within the hearing agenda.

Second, regarding point #8, it was characterized that we agreed that no
outstanding issues existed on the resort amendment at the time of our meeting.
Instead, we stated that we were still reviewing the shared parking provisions
of the amendment due to the potential for off-site displacement of public
parki nglsupport faci 1 i ti es for lagoon trai 1 access. Your explanation of the
shared parking program was helpful, but we explained the issue was still not resolved and we would have to further analyze the parking study and possibly further consult with the City on their assessment of the ability of the parking program to adequately park the resort project.
Finally, we questioned whether there was any trail realignment within the
resort planning area and sports facility. While neither you or Larry Clemens
identified such a realignment, we later discovered a realignment of the trail was being proposed.
