I received the December 6, 1995 letter from Aviara to Sherilyn Sarb regarding the special condition for community trail plan and construction. While the proposed wording for the condition it is not entirely clear from the Aviara letter, I believe that I can shed some light on the previous processing and potential phasing of the future trail. The City required that Aviara provide pedestrian access from Alga Road southward through the resort, eventually reaching Batiquitos Drive. This requirement came from two sources: the master plan community trail system and the General Plan provision for alternate forms of transportation. The master plan community trail system calls for the Stream and Lake Trail to traverse the resort area. This trail was originally shown on the exhibits for the original hotel (CDP 6-87-680) as an improved walkway, with staiways and walls, through the open space area east of the main hotel building. When the Four Seasons development proposal was revised in 1990 (CDP 6-87-680-A5) the trail was reduced to an unimproved pathway, still traversing the open space area east of the main hotel (see Exhibit No. 4 for CDP 6-87-680-A5). The current permit request (CDP 6-87- 680-A9) maintains the same alignment previously approved through CDP 6-87-680-A5. This alignment through the open space east of the main hotel is shown on the City's recently approved conceptual landscape plans for SDP 86-02(B). In addition to the naturalized trail system, pedestrian access through the resort area is provided by means of sidewalks and stairways. These pedestrian improvements were intended to provide an alternate form of movement through the resort area and are shown on the City's Site Development Plan/Tentative Map for SDP 86-02(8)/CT 95-02. Detailed improvement plans for Blue Heron Place have already been reviewed and approved by the City and these plans also show the sidewalk access. ~ __~ ___~___~ ____ ~ __ 2075 Las Palmas Drive - Carlshad, California 92009-1 576 - (61 9) 438-1 161 Bill Ponder December 12, 1995 Page 2 LCPA 3-95A - FOUR SEASONS AVIARA RESORT The phasing of these pedestrian access routes is a function of construction activities and planned occupancy of the hotel. Typically, the City does not require a trail or other pedestrian access route through an active construction site, especially one of the magnitude of the Four Seasons Resort. Since the sidewalk system is part of the hotel site and Blue Heron Place improvements, all sidewalks will be in place upon final inspection of the hotel site and structure, prior to occupancy. In accordance with other trails within Aviara, the natural trail through the open space would also need to in place prior to occupancy of the hotel. Should the Coastal Commission desire the applicant to add the natural trail through the open space to the Site Development Plannentative Map exhibits, no additional processing would be required. Should the Coastal Commission desire to remove the trail through the open space, the adjustment could be accommodated through the City's Substantial Conformance procedure since there will still be improved pedestrian access through the resort.
