SUBJECT MAJOR AMENDMENT 1-93 TO THE CllY OF CARLSBAD LCP MELLO
II SEGMENT (CARLSBAD RANCH SPECIFIC PLAN - LCPA 9048)
Dear Bill:
City staff has completed reviewing the staff report and recommendation for the above
referenced project. We are requesting clarification of the three suggested modifications
addressing the conversion of agricultural lands. In addition we are requesting the revision
of two suggested modifications. The City's request is as follows:

On page 11 in the first paragraph the additional text proposed makes it unclear
as to whether you are suggesting that the 92.6 acres of the Carlsbad Ranch
property which is developable pursuant to existing Policy 2-2 of the Mello II
Segment of the Coastal Plan is subject to Policy 2-1 and the three options for
conversion of agricuttural lands. Ci staff believes that the existing 92.6 acres
should not be subject to Policy 2-1 and requests that this be made clear. This
affects suggested modifications 1,5 and 6.
City staff supports suggested modification number 1 addressing the conversion
of agricultural lands yet disagrees with the way in which it has been applied in the
related coastal development permit for the project. We suggest that this
modification be revised to contain an exclusion for public recreational uses as well
as improvements to be utilized for agricuttural production. Specifically we believe
it is nut appropriate to apply the agricultural lands conversion policy to the driving
range, ro(1cIwBy improvements which benefit the agricultural operations, pedestrian
circulation system improvements and the proposed desittation basin.
In other cases it has been determined that the Agricuttural Conversion Migation
Fee is inappropriate for public recreational uses. The proposed driving range is
temporary in nature and will require the issuance of a conditional use permit. The
City limits the approval period for conditional use permits. With the importance
placed on public recreational uses in the Coastal Act we believe it would be more
appropriate to apply the fee when the land is converted to a permanent urban use.

In regard to the pedestrian link, Street ’B’, and the desittation basin the city views
these improvements as benefiting agricultural operations on the property and
therefore requests that they not be subject to the agricultural lands conversion
mitigation fee. The pedestrian link is intended to permit the public to experience
the flower fields while controlling public access to prevent damage to the crop as
well as interference with operations. Street ’B’ will be utilized by vehicles
supporting the agricultural operation as well as traffic to the urban uses. In regard
to the detention/desittation basin it will accommodate drainage from lands used for
agricutture to regulate the volume of water being discharged to the downstream
area. In addition it will allow settlement of suspended sediments from agricuttural
drainage prior to water being released from the site.
3. Suggested modification number 4 and 8 address the architectural embellishment
for the hotel site. The proposal to restrict the architectural feature to a height of
65 feet provided it is limited to one percent (1%) of the hotel’s overall roof area
reduces the size of the feature changing its proportional relationship to the
building. We are requesting that you revise the suggested modification to limit the
architectural feature to a maximum of three percent (3%) of the hotel’s overall roof
surface so that an appropriate proportional relationship can be maintained. This
will produce a more aesthetically pleasing architectural design.

On page 2 in paragraph one there is an additional reference to the proposed C-T-
Q zone beyond what is being proposed. The only place where this zone is being
proposed alone is on the west side of Paseo Del Norte.
On page 10 in the last paragraph the correct section number is 21.83.020.
On page 11 the code reference cited for modification number 6 should be
21.82.060, subsection C.
On page 14 in paragraph three the proposed combination land use designation
for a portion of the Village Center of C/O/PI was omitted. This should be inserted
in the report.
On page 29 there is a typographical error in the table indicating the proposed
zoning designations. The proposed designation for parcels 6 & 7 is C-2-Q/O-Q/F-
M-Q.
