Carlsbad Ranch Company, L.P., as the project applicant, submits the following to be added to the project description: Permit Application for CDP 6-96-9 Trails With respect to the proposed trails easements identified on the Master Tentative Map for Carlsbad Ranch (C.T. 94-09) (the “Tentative Map”) for which the Coastal Development Permit is requested, the Tentative Map will include a statement in the Notes to the effect that (i) said trails shall be for use by the general public and (ii) easements for the trails identified on Attachment A hereto shall be dedicated to the City of Carlsbad (the “City”) on the final subdivision map which includes the easement area, or an irrevocable offer to dedicate such trail easements shall be given to the City on or before the date such final map is recorded in the Office of the County Recorder of San Diego County. With respect to the trail identified on Attachment A as the ResortlLEGOlAND trail, a rest/vista point shall be provided that includes benches and a trash receptacle. An illustration of the concept is attached as Attachment 8. Conve rsion Mitiaation Fee .. . With respect to conversion of property within the Tentative Map area from agricultural use to an urban use: 1. Conversion Options 1 and 2 provided in Policy 2-1 of the Mello II LCP Land Use Plan shall be eliminated from consideration. Except for acreage that is exempt from said Policy, a mitigation fee shall be paid under Conversion Option 3. 2. The acreage to which the mitigation fee is applicable is consists of approximately 202 acres and is shown on Attachment 3 (Le., Lots 2, 6, 7, 9, 13, 14, 17 and portions of 8 and 18 of the Tentative Map. 5600 AVENIDA ENCINAS SUITE 100 CARLSBAD, CALIFORNIA 92008 U.S.A. Bill Ponder March 21, 1996 Page 2 In the event the proposed golf course is not exempt, or the exemption is voided, then the mitigation fee shall also be applicable to Lots 3 and 5 of the Tentative Map consisting of approximately 74 acres as shown on Attachment 3. 3. Conversion mitigation fees for any lot shall be paid to the City upon issuance of a building permit for any improvement constructed on such lot, except for any fees due for the proposed golf course. Any fees due for the proposed golf course shall be paid upon issuance of a grading permit for golf course purposes or, in the event such golf course is initially exempt from the payment of conversion mitigation fees and the exemption is later voided, then such fees shall be paid at the time the exemption is voided. Please note that the ResorVLEGOLAND trail is within a 42’ wide water and trail easement so no additional easement area will be necessary to accommodate the resthista point.
