'fie contradictions in government continue at a pace unprecedented. While on one hand the state government, through the efforts of Governor Wilson, boast the agenda of . "cutting the red tape" and getting serious about business in CaIifornia; on the other hand, the California Coastal Commission continues at "break neck" speed to slow, complicate, and stop development projects. Forgetting their original purpose and intent of providing shoreline protection and access, the Coastal Staff has now decided they are going to be a powerhouse figure in the environmental struggle of habitat preservation. Albeit this Is a dpazp way from theh legislated purpose, and far beyond their authority; riot to nieiitioti a level of goveriiiiieiit control that is repetitive and duplicative of the California State Fish & Game, U.S. Fish & Wildlife Service, and City of CarBbad efforts. With all that said as a bdef background, the case in point is that Coastal Staff is currently processing the City's LCP Amendment for Aviara Phase III (scheduled for Coastal Commission in May) and the Aviara Phase IU application for permit (tentatively scheduled for June). Coastal Staff has effectively informed me that: 1, They have forgotten the essence of the deed restriction/open space trade-off program approved by the Commission in 1988. (Phases I and I1 have both used the approved methodology as the guide for development approval). Coastal Staff is now disagreeing With the original approved master mitigation prugrarn; and 2. Coastal Staff has taken the position that they want all State Fish & Game and US. Fish & Wildlife approvals before proceeding to the Coastal Commission hearing of either the LCP amendment or permit. It should i not be the Coastal Staff's responsibility to add yet another liyycr of control which delays, or prevents projects to be heard at public hearing. Mayor Bud Lewis April 27, 1994 Mayor Lewis, this is a very serious issue not only for Aviarti., but the City of Carlsbad. We need to collectively, with the fuli force of the City, state elected representatives, and the Governor’s ofice, to provide immediate guidelines as to Coastal’s authority and necessity of hvolvement in the habitat protection enforcement. As this is a matter currently being processed, staff reports being written and agcndized by Cuutal Staff, your immed iate attention and acti on is nccdcd, I would be pleased to meet with you to provide further ioformation.
