Dear Deborah:
As you know, I met July 29 with Ellen Banyman, U.S. Fish and Wildlife Service and
David Lawhead, California Department of Fish and Game to discuss resolution of Aviara Phase LZI habitat issues.
The meeting was very comprehensive and provided an opportunity for all participants to
share information and reach conclusion. It was concluded that:
A. PA17
1. The open space corridor north of Planning Area 17 will be widened to
approximately Lot 31;
2. A "critter crossing" will be provided in the proposed Ambrosia Street extension;
3. Aviara will discuss with Carlsbad City Engineer the possibility of eliminating
street lights on Ambrosia at the open space crossing area.
1. The North/South open space corridor immediately east of Planning Area 22
will be widened by the elimination of the most easterly lots (Lots 150-154),
and that an effort will be made to move the remaining lots westerly by
studying the reduction of a graded slope on the west boundary and by
increasing the grade on the entrance street;
2. A "critter crossing" will be provided in the entry road to PA 22;
3. Re-vegetation plan will be provided for the area where the easterly lots are being eliminated (concentrating on southern maritime chaparral). These
areas can be sold in the future as mitigation areas for other developers;
4. Discuss with City the reduction of traffic on the PA 22 entry road (Le. private
street, gated community and no westerly continuation beyond Aviara's westerly boundary.

A narrative and exhibits will be provided the USF&WS and DF&G next week for their review. On concurrence that Aviara’s revisions mirror our meeting conclusion and agreement, both agencies will send you a letter acknowledging their agency’s approval of
Phase Ill habitat and open space provisions.
The agencies recognize that without the California Coastal Commission’s acceptance, coupled with the USF&WS and DF&G concurrence, the proposals outlined in this letter
will be withdrawn and that Aviara retains the right to pursue, and have acknowledged,
that the Aviara Phase 111 CEQA process and EIR certification were properly prepared,
administered and approved by the City of Carlsbad as lead agency.
Aviara’s compromise with the Resource Agencies (federal and state) were done with the
spirit of cooperation and expediency, and although solves the last remaining known
Coastal Staff issues of Phase III, the disagreement with Coastal Staff‘s processing
methodology, code interpretations, and authority to review and administer NCCP matters still remains. I am hopeful that post-Phase III, we can work together to solve
these problem areas.
Your immediate attention is requested upon receipt of the Resource Agency’s approval letters, to revise your Staff Report and recommendations, in advance of the August Coastal Commission hearing, to recognize the resolution of the resource protection issues, and, therefore, provide the necessary findings to recommend approval of Phase m.
