LCPA 92-02 - BEACH AREA LAND USE STUDY

Enclosed is the City of Carlsbad's completed application to amend the Land Use Map of the
Mello I1 Local Coastal Program. The subject property is in the southern portion of the
City's Beach Area Overlay Zone, east of Garfield Street as shown on the attached location
map. The application is for the changes to Zoning, General Plan and Local Coastal Plan
designations based on recommendations of a Council directed land use study. City Council
approved this LCPA and corresponding General Plan Amendment (GPA 92-09) and Zone
Change (ZC 92-01) on April 20, 1993.
The support documentation specified on the application checklist is enclosed. Should you

N. SUMMARY OF AMENDMENT PROPOSAL
Amendments to the Mello 11 LCP will involve the study area shown on the attached location map.
Specifically, General Plan and zoning land use designation changes are proposed. Therefore, a
General Plan Amendment (GPA 92-9) and Zone Change (ZC 92-1) are also being processed with
this LCPA. The Mello I1 LCP currently identifies the study area as Medium-High Density (10-20
dwelling units per acre) and permitted uses and development standards are designated as those
found in the RD-M Zone. The existing and proposed zoning and General Plan designations are
reflected in Exhibits "A"-"C". (Attached).
The proposal is the result of a City Council directed land use study for this area to address
neighborhood compatibility issues which surfaced during the North Beach Planning and Traffic
Study of 1987. The proposed designations are designed to eliminate current zoning and General
Plan inconsistencies as well as eliminate the existing non-compatible mix of single family and
multi-family zoning. The proposal does not represent an overall increase in allowable units within
the study area. The LCPA is required to bring the LCP coastal land use designations in
conformance with the Citfs General Plan and zoning land use designations.

3. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE
PR.EVtOUSLY CERTIFIED LCP
The proposed LCP Amendment will bring the coastal land use designations into
conformance with the City‘s General Plan and Zoning designations. The proposed project
(including General Plan Amendment 92-09 and Zone Change 92-01) modifies existing land
use designations to eliminate current conflicts, inconsistencies and potential for
incompatible development.
This project will have no impact on the policies or provisions of the Mello I1 LCP. The
proposed land use designations comply with all applicable policies of the Mello 11 LCP.
4. ZONING MEASURES THAT w[LL IMPLEMENT THE LCPA
A Zone Change was approved by the Planning Commission and City Council which provide
a means of implementing the LCPA. The proposed zone change will change the zoning from an existing mix of R-1 (single-family) and RD-M (multi-family zone) Zones to
primarily R-2 zones as shown on the attached exhibits. The details of these designations
are discussed in the attached staff report.
This amendment will retain consistency between the Local Coastal Program, General Plan,
and the Zoning Ordinance. The Beach Area Overlay Zone remains over this area and
requires the approval of a site development plan prior to development. This provides the
City with a discretionary review process to ensure compliance with all applicable design
and development requirements.
6. ANALYSIS OF POTENTlALLY SIG”T ADVERSE CUMULATIVE IMPACTS ON
COASrM RESOURCES
The proposed LCPA will not create additional impacts to coastal resources in the area, or
associated with Agua Hedionda Lagoon. The area is an existing neighborhood with infill
lots that are either vacant or could be redeveloped. Since this proposal does not increase
the overall maximum units allowed, there will not be an adverse impact to the coastal
resources of the area.
8. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTICIPATION
PUBLIC PARTICIPATION
The core of the land use study centered around the involvement of the property owners of
the area. The study was initiated with a certified mailing to all study area property owners
to give input regarding the desirability of all R-1 (single family) zoning for the area. Final

assessment of all input showed a split between favoring all R-1 or maintaining the multi-
family zoning. The proposed designations, therefore, represent a compromise situation
where emphasis is on product type control and maintenance of neighborhood character
compared to the potentially incompatible development allowed under current designations.
From April to August 1992, staff received input and discussed development issues with
property owners over the phone and in individual consultations. On August 20, 1992 a
collective meeting with property owners was held at Heritage Hall to discuss the final
recommendation which was sent to them via certified mail two weeks previously. Planning
Commission public hearing considered the final recommendation (same as this amendment
application) with no opposition presented by the public or property owners. Soliciting and
assessing the public input early in the process was a driving force in the development of
the proposed R-2 and related land use designations. Copies of pertinent notices are
attached. No comments were received during the project's environmental review period.
AGENCY PARTICIPATION
Once the recommendation was finalized, the City proceeded with the 6 week public review period
and followed up with correspondence to the Coastal Commission advising of this project and asked
for any needed information regarding the processing of the LCPA. Copies of the correspondence
sent to the Coastal Commission regarding this project are attached.
