A public hearing on the amendment request by the Coastal Commission has been scheduled at the time and location stated below. Any persons wishing to attend the hearing and present testimony are so invited. DATE: May 12, 1994 TIME: 9:00 a.m., Thursday LOCATION: Renaissance Hotel - LAX 9620 Ai rport Boulevard Los Angeles, CA 11. HEARING PROCEDURES At the time of the public hearing, staff will make a brief oral presentation to the Commission. Immediately following the presentation of the staff, a representative or representatives from the City of Carlsbad may address the Commission regarding the local coastal program amendment. Upon conclusion of the City's presentation, interested members of the public and agencies will have an opportunity to address the Commission and comment on the amendment. The Commission will then close the public hearing; and, since there are prel irninary recommendations and findings prepared for the Commission, the Commission mav take final action on the amendment reauest at t his time. I I I . BACKGROUND The Carlsbad Local Coastal Program consists of six geographic segments. Pursuant to Sections 30170(f) and 30171 of the Public Resources Code, the Coastal Cornmission prepared and approved two portions of the LCP, the Mello I and I1 segments in 1980 and 1981, respectively. However, the City of Carlsbad found several provisions of the Mello I and I1 segments unacceptable and declined to adopt the LCP implementing ordinances for the LCP. 1985, the Commission approved major amendments, related to steep slope protection and agricultural preservation, to the Mello I and I1 segments, which resolved the major differences between the City and the Coastal Commission. working toward certification of all segments of its local coastal program. Since the 1985 action, the Commission has approved several major amendments to the City of Carlsbad LCP. In October, The City then adopted the Mello I and I1 segments and began .-. Carlsbad LCPA 1-94 Page 2 The Agua Hedionda segment has been partially completed with the Commission having certified the Agua Hedionda Land Use Plan in 1982. In addition, two new segments were annexed to the City, the West Batiqui tos/Sammi s Properties Segment certified in 1985 and the East Batiquitos/Hunt Properties Segment. The East Batiquitos/Hunt Properties Segment was certified in 1988. IV. AMENDMENT REOUEST This item was originally scheduled for the Commission's April 1994 hearing; however, the Commission waived the applicable time limits for Commission action at the City's request to allow all three submitted amendments to be reviewed as one major amendment package. Regarding the amendment request to allow residential density bonuses in each LCP segment to enable the development of lower income affordable housing, this item has been continued by staff pending consultation with the State Department of Housing and Community Development (HCD). HCD has requested an opportunity to meet with An amendment request for the West Batiquitos Lagoon segment would replace the formerly approved Batiquitos Lagoon Education Park (ELEP) Master Plan with the Poinsettia Shores Master Plan. The subject 168 acre property is located adjacent to the north shore of Batiquitos Lagoon west of 1-5 and east of Carlsbad Boulevard. The BLEP master plan provided for a major university with related land uses which would now be replaced with residential land uses. The proposed Poinsettia Shores Master Plan wi 11 retain the travel servi ce/ commercial land uses currently allowed by BLEP for the property's west side. Other changes include modification of planning area boundaries, realignment of streets and revisions to the originally adopted development and design standards. An amendment request for the Mello I and East Batiquitos Lagoon segment would revise the Phase I11 sub-area of the Aviara Master Plan, which controls development of 1,402 acres on the north shore of Batiquitos Lagoon, east of 1-5 and west of El Camino Real. pl anni ng area and open space boundaries , real i gnment of streets, addi ti on of 37 units to the previously approved plan in Phase I11 of the master plan and alteration of residential product mix.
