AMENDMENTS (LCPA 93-02, LCPA 94-02 AND LCPA 95-01) DEALING Dear Ms. Lee: Enclosed for review are three completed applications from the City of Carlsbad to amend it’s Local Coastal Program with respect to the addition/modification of policies and implementing zoning dealing with affordable housing. In October of 1991, the Carlsbad City Council approved a major amendment to it’s Housing Element (GPA 90-08) to add new policies to encourage and enable the development of affordable housing within the City. As a consequence, of this major Housing Element amendment, the State Department of Housing and Community Development (HCD) formally certified the City’s Housing Element on May 26, 1992. Subsequent to the certification by the State, the Carlsbad City Council approved several affordable housing zone code amendments (ZCAs) to implement the new Housing Element policies. These zone code amendments include the following: ZCA 91-05 - Density Bonus Ordinance; ZCA 91-06 - lnclusionary Housing Ordinance: ZCA 92-02 - Affordable Housing Site Development Plan Procedures and Standards Modifications (Le.; Density Increases); ZCA 92-04 - Second Dwelling Units; and ZCA 93-05 - Senior Citizen Housing. The Local Coastal Program Amendments proposed with this application will add affordable housing policies to the City’s six Local Coastal Program (LCP) segments and adopt the above noted companion zone code amendments as the implementing zoning for the City’s LCP. This LCP amendment is necessary to ensure consistency between the City’s amended Housing Element, Zoning Ordinance and it’s LCP. Any lower-income affordable housing proposal requesting a density increase would be reviewed relative to: (1) (2) (3) The project's compatibility with 'adjacent land uses; it's compliance with certain locational criteria: and the existence of adequate public facilities. This proposed amendment is necessary to bring the City's Local Coastal Program Segments into conformance with the City's recently amended Housing Element. The proposed amendment would retain the existing land use densities for projects not providing lower-income affordable housing or projects providing such housing without requesting density increases. AlTACHMENT “c’ 3. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFIED LCP The proposed LCP Amendment will bring the coastal land use policies of the Mello I, Mello II, Agua Hedionda, East Batiquitos Lagoon, West Batiquitos Lagoon, and Village Redevelopment Area LCP segments into conformance with the City’s recently amended General Plan. The proposed amendment would add a new land use policy to each LCP segment, which would allow residential density increases above the maximum densities permitted by the City’s General Plan and the Local Coastal Program segments to enable the development of lower-income affordable housing. Since all projects requesting a density increase would remain subject to all applicable policies and provisions of the respective LCP segments, the proposed amendment is not anticipated to impact other sections of the LCP’s. 4. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA A Zone Code Amendment (ZCA 92-02) was. approved (August, 1992) by the Planning Commission and City Council which would provide a means for implementing the LCPA. Specifically this ZCA would allow development standards modifications (including density increases) to enable the development of lower- income affordable housing through processing a Site Development Plan, pursuant to Chapter 21.06 of the Carlsbad Municipal Code. This amendment will ensure consistency between the Local Coastal Program segments, the City’s General Plan and the Zoning Ordinance. The Site Development Plan requirement provides the City with a discretionary review process to ensure compliance with all applicable LCP policies and provisions. 5. AFFECT ON PUBLIC ACCESS This proposed LCPA is not affiliated with any specific development project and therefore will not directly affect public access to and from the coast. Any future project requesting a density increase, pursuant to this amendment, shall be required to adequately mitigate associated parking and traffic impacts. 6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES This proposed LCPA, which would incorporate a new land use policy to allow density increases, to enable the development of affordable housing, is not anticipated to result in significant adverse cumulative impacts to coastal resources. As discussed earlier, any project proposing a density increase, shall be required to comply with all applicable LCP policies and provisions including those dealing with the protection and/or preservation of coastal resources. The City’s already approved Zone Code Amendment (ZCA 92-02) which would allow development standards modifications to enable the achievement of higher density affordable housing, provides a mechanism to increase project densities within unconstrained, developable areas of any given property without encroaching into sensitive coastal resources. Accordingly, no significant impacts to coastal resources are anticipated. 8. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTlCl PATI ON This Affordable Housing Policy, which would allow residential density increases to enable to development of lower-income affordable housing was initiated through a new policy and program added to the City’s recently amended Housing Element (GPA 90-08). The City’s draft Housing Element was extensively reviewed by the public, including; six public workshops; three public hearings before the Planning Commission and one before the City Council. The City Council adopted the amended Housing Element (GPA 90-08) on October 22, 1991. The proposed LCPA 93-02 has undergone a six (6) week public review period. LCPA 93-02 was heard before the Planning Commission and City Council on November 3, 1993 and January 11, 1994, respectively. During all public workshops and hearings there was no opposition presented by the public. Copies of the pertinent notices are attached.
