This letter 4s in reference to the status of the above iocal coastal pragtarn amendment (LCPA). Both components of LCPA #1-95 are proposed as zone code amendments to the Carlsbad Local Coastal Program (LCP). Regarding the "affordable housing" amendments (LCPA 94-02), we belIev8 the two proposed revlsions addresslng second dwelling unl ts and tenlor citlzrn housing need companion land use plan changes slnce they have the potentlal to allow Increases In denslty above those densltles currently certifted In the six segments of the Carlsbad LCP. As currently certlfled, the maximum density permitted in the Carlsbad 1CP IS 23 dulac. As you know, LCPA bl-85 deleted all affordable housing provlslons From the Carlsbad LCP, Including those ptovfsions assoclated wlth affordable houslng that would a1 low dens1 ty Increases above the martlmum perm1 tted denslty. Glven that the proposed amendment could allow unl1mlted denslty for affordable housing and given that .the..sfandard of review for zon Ina amendments is c.onformltv Wh tt , we cannot support the proposed amendment as presently submitted. Thus, we believe It would be prudent for the Clty to withdraw the amendment: request at this the, You indicated your nllllngness to proceed In this manner. Conslstent with our meetlng recently, we understand the Clty's Interest and goal to comply with state law regarding affordable housing, As we discussed at length, we wlll work wlth you on provldlng speclflc land use plan pollcy direction for a future amendment that would accommodate possible increases In dens1 ty wl thout resul ting In possl ble adverse Impacts to coastal resources or pub1 1 c access . Regarding the "Development Agreements" amendments, revlsions to an "exlstlng'' Chapter 21,70 of the City's Municipal Code are proposed.
