Specifically, during this past year, the City of Carlsbad approved two zone code amendments dealing with affordable housing (i.e., ZCA 93-05 - Senior Citizen Housing and ZCA 92-04 - Second Dwelling Units). This proposed Local Coastal Program Amendment will ensure consistency between the City’s amended zoning ordinance and the LCP. The Carlsbad City Council approved this LCPA and corresponding Zone Code Amendments as follows: LCPA 94-02 - February 14, 1995 ZCA 93-05 - April 19, 1994 ZCA 92-04 - June 21 , 1994 The support documentation specified on the application checklist is enclosed. The amendment to the City's Zoning Ordinance includes the following provisions: SENIOR CITIZEN HOUSING 1. Delete the existing maximum 75 dulacre density provision for Senior Citizen Housing and replace this with a density standard which allows the City to grant a minimum density increase of at least 25% over the Growth Control Point of the applicable General Plan designation. This revision * is consistent with the density increase provisions of State Density Bonus Law (Government Code Section 65915). 2. Incorporate a 15% lower-income inclusionary housing requirement for Senior Citizen Housing projects. This is consistent with the City's Inclusionary Housing Ordinance. 3. Establish locational guidelines and design and development standards which respond to the special housing needs of senior citizens. SECOND DWELLING UNITS 1. Delete the Conditional Use Permit (CUP) requirement for Second Dwelling Units and allow Second Dwelling Units to be proposed and approved administratively (Administrative Permit) through the Planning Director. 2. Allow Second Dwelling Units to be approved on residential lots which are smaller than 7,500 square feet (SF) in area. 3. Increase the maximum permitted floor area for a Second Dwelling Unit from 350 SF to 640 SF. This revision will enable the development of 1 bedroom Second Dwelling Units. 4. Allow the required parking space for a Second Dwelling Unit to be satisfied through tandem parking in the driveway of the primary residence. 5. Delete all occupancy requirements (including restrictions on the permitted number and age of occupants) for Second Dwelling Units. 6. Allow Second Dwelling Units to be developed attached to or detached from the primary residence. No text amendments to the City's six Local Coastal Program segments are proposed. ATTACHMENT 'IC" 3. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFED LCP This proposed amendment will: (1) revise the density provisions (from a maximum of 75 du/acre to a minimum of a 25% density bonus) and development standards for Senior Citizen Housing within the City of Carlsbad and (2) provide more flexible development standards to enable the achievement of Second Dwelling Units within the residential zones of the City. However, since all Senior Citizen and Second Dwelling Unit projects shall be required to be consistent with all applicable development standards, policies and provisions of the respective LCP segments this proposed Local Coastal Program Amendment is not expected to impact other sections of Carlsbad's Certified LCP. 4. ZONTNG MEASURES THAT WILL IMPLEMENT THE LCPA Two Zone Code Amendments, which are the implementing ordinances for this LCPA, were approved by the Carlsbad City Council as follows: 1. 2. ZCA 93-05 - Senior Citizen Housing - April 19, 1994; and ZCA 92-04 - Second Dwelling Units - June 21, 1994. 5. AFFECT ON PUBLIC ACCESS This proposed LCPA is not affiliated with any specific development project and therefore will not directly affect public access to and from the coast. Any future Senior Citizen or Second Dwelling Unit project which is processed pursuant to these amended regulations and provisions shall be required to address and adequately mitigate parking, traffic and coastal access impacts. 6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES This proposed LCPA (Zoning Ordinance Amendment) is not anticipated to result in significant adverse cumulative impacts on coastal resources. Any Senior Citizen or Second Dwelling Unit project processed pursuant to these new regulations shall be required to comply with all applicable LCP development standards, policies and provisions, especially those dealing with the protection and/or preservation of coastal resources. Potential environmental impacts associated with the development of Senior Citizen or Second Dwelling Unit projects within the Coastal Zone, pursuant to the amended regulations, include: soil erosion, landform alteration, geotechnical, visual quality, parking, traffic, and biological. These potential impacts shall be required to be adequately mitigated consistent with Coastal Policies and the California Environmental Quality Act. 8. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTICIPATION Each of the affordable housing Zone Code Amendments discussed herein were heard before and approved by the Carlsbad Planning Commission and City Council as follows: Senior Citizen Housing - ZCA 93-05 C.C. - April 19, 1994 Second Dwelling Units - ZCA 92-04 C.C. - June 21, 1994 P.C. - February 16, 1994 P.C. - April 6, 1994 The proposed LCPA 94-02 has undergone a six (6) week public review period (October 20, 1994 - December 2, 1994). LCPA 94-02 was heard before the Planning Commission and City Council on December 21, 1994 and February 14, 1995, respectively. During the public hearings there was no opposition presented by the public. No comments were received during the environmental review periods for the ZCA’s or LCPA 94-02.
