The amendment modi fi ed the Land Use Plan (LUP) text of all six segments of the Carlsbad LCP m10 I, - Me1 1 O-TI, Agua- He-wo-i-da, Vi 1 lage' Redevelopment, East Bati qui tos Lagoon and West Batiqui tos Lagoon) by incorporating language addressing senior citizen housing, second dwelling units, density increases and inclusionary housing. In addition, portions of the Implementing Ordinances (zoning code) were revised to incorporate new residential standards addressing the needs of senior citizens and low and moderate income persons. allow for density bonuses, relaxation of existing development standards and financial incentives to encourage the construction of affordable housing. However, before the LCP amendment can be deemed certified, the Executive Director must determine that implementation of the approved amendments will be consistent with the Commission's certification order. This is necessary because the amendment was certified with suggested modifications. In order for the Executive Director to make this determination, the local government must formally acknowledge receipt of the Commission's resolution of certification, including any terms or suggested modifications; accept and agree to those terms and modifications; take any formal action which is required to satisfy them, such as adoption of revised ordinances incorporating the suggested language modifications; and agree to issue coastal development permits consistent with the amendments, as certified. As soon as the necessary documentation is received in this office, and accepted, the Executive Director will report his/her determination to the Commission at its next regularly scheduled pub1 i c hearing. I' The inclusionary housing mandate requires that a minimum of 15% of all units approved in any residential master plan, specific plan, or residential project shall- be made affordable to lower income households. An in-lieu fee may meet the requirement to construct lower income housing for residential developments of fewer than 7 units.
