Specifically, this application includes a request to amend the Mello II Local Coastal Program Land Use Map to change the permitted land use designation and zoning on the 11.99 acre Laurel Tree property from Office and Related Commercial (0) to Residential High (RH 15-23 dulac) and from Office (0) to Residential Density Multiple with a Qualified Development overlay (RDM-Q) respectively, for the purpose of enabling the development of a 138 unit affordable housing project. The Carlsbad City Council approved this LCPA and other discretionary permits associated with the Laurel Tree project &e.; General Plan Amendment, Zone Change, Local Facilities Management Plan Amendment, Site Development Plan and Hillside Development Permit) on November 7, 1995. The support documentation specified on the application checklist is enclosed. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFIED LCP The proposed land use change from Office and Related Commercial (0) to Residential High (RH 15-23 du/ac) and zone change from Office (0) to Residential Density Multiple with a Qualified Development Overlay (RDM-Q) to enable the development of the 138 unit Laurel Tree Affordable Housing project (15.31 du/ac) is consistent with all sections of the Mello II LCP. Specifically: a. The project as proposed is in compliance with the steep slope/sensitive vegetation policies of the LCP; b. As discussed in the approved Mitigated Negative Declaration for the project, all project environmental impacts have been mitigated; C. The project has been conditioned to mitigate the conversion of prime agricultural soil (Class 11) to a residential use through the payment of an agricultural mitigation fee; d. The development of the project would not preclude or negatively affect agricultural use on the adjacent property to the north; and e. The project will include an on-site de-pollutant basin to control drainage and prevent erosion into Encinas Creek. 4. ZONING MEASURES THAT WILL IMPACT THE LCPA A Zone Change (ZC 95-01) from Office (0) to Residential Density Multiple with a Qualified Development Overlay (RDM-Q) is proposed as part of this LCPA and 138 unit residential project application request. The RDM zone is a multi-family residential zone which provides standards to enable the development of multi- family projects upon properties which are designated for higher residential densities by the General Plan. Accordingly, this zone is consistent with and will implement the RH Mello II Land Use Plan and City General Plan redesignation proposed with this application. 5. AFFECT ON PUBLIC ACCESS Approval of this requested land use change from Office (0) to High Density Residential (RH)and zone change from Office (0) to Residential Density Multiple with a Qualified Development Overlay (RDM-Q) will have no impact on pubic access. The Laurel Tree project has been conditioned to construct Alga Road (full width grading and half street improvements) from the project site northward to Palomar Airport Road. In that Palomar Airport Road is a primary access arterial from inland communities to the coast, this project will enhance costal access opportunities. The anticipated Average Daily Traffic (ADT) for the 138 unit apartment project is 11 04 ADT. In comparison, the development of the property with an office use and zone would generate approximately 2940 ADT. Accordingly, approval of this land use and zone change and project will incrementally improve future local circulation and coastal public access. Otherwise, the project will include adequate onsite parking to serve the needs of the project’s residents and guests. 6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES Approval of this requested land use change from Office and Related Commercial (0) to High Density Residential (RH) and zone change from Office(0) to Residential Density Multiple with a Qualified Development Overlay (RDM-Q) will have no adverse cumulative impact on coastal resources. As discussed in the approved Mitigated Negative Declaration for the project, implementation of the 138 unit apartment project will (1) result in the take of 0.82 acres of high quality Coastal Sage Scrub habitat (0.74 acres of this take is located within the right-of-way for Alga Road); (2) impact 870 square feet of riparian vegetation (associated with the construction of Alga Road across Encinas Creek); and (3) convert prime agricultural soil to an urban use. However, appropriate conditions have been incorporated into the project resolutions of approval to adequately mitigate these project impacts. No other adverse cumulative impacts to coastal resources will occur. 8. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTICIPATION The Laurel Tree Local Coastal Program Amendment (LCPA 95-02) was heard before and approved by the Carlsbad Planning Commission and City Council on the following dates: Planning Commission: September 20, 1995 City Council: November 7, 1995 On May 2, 1995, copies of the draft Environmental Impact Assessment Form Part II for the project were sent directly to the California Coastal Commission staff, California Department of Fish and Game and the U.S. Fish and Wildlife Service for review and comment. On July 7, 1995, the Mitigated Negative Declaration for this proposed project was also sent directly to these same agencies for review and comment. No comments were received. This proposed LCPA 9562 has undergone a six (6) week review period (April 21, 1995, to June 3, 1995). During this review period no comments were received.
