B. C. D and E) LUTHERAN HOMES: VILLAGE REDEVELOPMENT/DESIGN MANUAL: CARLSBAD RANCH; LAUREL TREE APARTMENTS AND AVIARA PAS 5 and 12 The California Coastal Commission has received a request by the City of Carlsbad to review and certify an amendment to its Local Coastal Program (LCP) Land Use Plan and Implementation Plan. A public hearing on the five parts of the LCP amendment reauest bv the Coastal Commission has been scheduled at the time and location stated be-. Any persons wishing to attend the hearing and present testimony are so invited. I. HEARING TIME AND LOCATION DATE: April 11, 1996 TIME: 9:00 a.m., Thursday LOCATION: Carmel Mission Inn 3665 Rio Road Carmel CA 11. HEARING PROCEDURES .. . I\ . At the time of the public hearing, for each part of the City's amendment request, staff will first make a brief oral presentation to the Commission. Immediately following the presentation of the staff, a representative or representatives from the City of Carlsbad may address the Commission regarding the local coastal program amendment. Upon conclusion of the City's presentation, interested members of the public and agenc es will have an opportunity to address the Commission and comment on the request. The Commission will then close the public hearing and, since there are preliminary recommendations and findings prepared for the Commission the Commission may take final action on the local coastal Droqram submittal at this time. Each mrt (A - E) of the City's amendment reauest will be heard individuallv and acted on separate1 v. 111. BACKGROUND The Carl sbad Local Coastal Program consists of six geographic segments. Pursuant to Sections 30170(f) and 30171 of the Public Resources Code, the Coastal Commission prepared and approved two portions of the LCP, the Mello I and I1 segments in 1980 and 1981, respectively. found several provisions of the Mello I and I1 segments unacceptable and declined to adopt the LCP implementing ordinances for the LCP. 1985, the Commission approved major amendments, related to steep slope protection and agricultural preservation, to the Mello I and I1 segments, which resolved the major differences between the City and the Coastal Commission. Since the 1985 action, the Commission has approved several major amendments to the City of Carlsbad LCP. IV. AMENDMENT REOUEST/HISTORY The subject amendment request includes five parts which will be. heard and acted on separately. They are as follows: CARLSBAD LCP AMENDMENT 1-96A - LUTHERAN HOMES The proposed amendment request consists of a revision to the Carlsbad Village Redevelopment P1 an and Vi 11 age Design Manual which compri se the certified Land Use Plan for the Carlsbad Village Redevelopment Area. The proposed amendment represents a site-specific amendment to exempt Carlsbad-by-the-Sea Lutheran Homes from the requirement in the certified LUP which specifies that the ground floor of any development be devoted entirely to visitor-serving commerci a1 uses. The subject amendment request wi 11 essentially result in repeal i ng the existing Vi 1 lage Design Manual and replace it with a new "Vi 1 lage Redevelopment Master Plan and Design Manual" which functions as the principal LUP component for the Carl sbad Vi 1 lage Redevelopment area. The proposal a1 so 1 ncorporates a new "Housi ng and Redevelopment Commission Pol i ci es and Procedures Manual" and amendments to Chapters 2.24, 2.26, 21.35, 21.41. and 21.81 of the Municipal Code in order to assure consistency with the Code and Design Manual. The most significant changes are that the land use areas and boundaries have been reorganized and reconfigured within the plan area. The primary commercial-touri st area which has historically been along the Carl sbad Boulevard (Old Highway 101) corridor has been narrowed in size and the provision that visitor-serving commercial uses be required on the ground floor will no longer be mandated as specified in the existing LUP. provides for variances to the height and building coverages, proposes the implementation of parking options to satisfy on-site parking requirements - including an in-lieu fee parking program. In addition, sidewalk cafes will become a permitted use whereas presently they are not permitted pursuant to the municipal code. The LUP also CARLSBAD LCP AMENDMENT 1-96C - CARLSBAD RANCH The proposed amendment revises the Land Use Plan (LUP) text and maps of the Agua Hedionda and Mello I1 segments of the Carlsbad Local Coastal Program (LCP). Also proposed are amendments to the LCP Implementation Plan (IP) which consist of zone changes as well as text amendments to the Carlsbad Ranch Specific Plan and the Coastal Agricultural Overlay Zone. These amendments are proposed to make the General Plan, Zoning, and Carlsbad Ranch Specific Plan consistent with the LCP. The proposed amendment modifies the certified land use and implementation plans for the Mello I1 segment regarding 423.5 acres on the north side of Palomar Airport Road, south of the future extension of Cannon Road, and east of Paseo Del Norte known as the ""Carlsbad Ranch" to allow the development of office, research and development, related light manufacturing, commercial, hotel/timeshare, destination resort, golf course, agriculture, a vocational school campus and Legoland Carlsbad. The above uses would take place within 19 planning areas. The City proposes to modify the Mello I1 LUF as follows: 2-1 (Conservation of Agricultural Lands) to apply it to the area of the Carl sbad Ranch within the agricultural preserve with the exception of approximately 52 acres to be retained for agricultural use; this policy allows conversion of approximately 301 acres of agricultural lands on the Carlsbad Ranch to urban uses if adequately mitigated and (2) provides that any acreage under the control of a public entity for use as public recreation or open space will be exempt from Policy 2-1. This would allow the proposed golf course to be exempt from the agricultural mitigation program. The amendment , also allows development of agricultural lands previously under Williamson Act Agricultural Contract provided compliance with the LCP's agricultural conversion mitigation requirements is achieved. Amendments to Mello I1 LUP Policy 2-2 (Carlsbad Ranch "Mixed-Use" development) include (1) a provision that development of land within the agricultural preserve be subject to approval of a LCPA and compliance with Policy 2-1 and (2) reducing the structural setback from 50 feet to a minimum of 25 feet from the adjacent agricultural area. Revision #1 to this policy serves to tie the requirements of Policy 2-1 to the areas of the Carlsbad Ranch not allowed to develop under the Carlsbad Ranch "Mixed-Use" development policy. Amendments to the Mello I1 LUP map are proposed to revise land use designations to be consistent with the proposed land uses. In addition, the City has adopted a new Carlsbad Ranch Specific Plan as part of this effort. The amendments to the implementation plan consist of revisions to the Coastal Agricultural Overlay zone to apply the overlay to the Carlsbad Ranch property within the agricultural preserve, with the exception of the approximately 52 acres which are to be retained in agricultural use. An amendment is also proposed to the Agua Hedionda Land Use Plan segment to revise Policy 2-2 to permit a 24.2 acre area adjacent to and north of Cannon Road to be used as part of a proposed golf course and allowing it to be zoned as Open Space (0-SI rather than Exclusive Agriculture (E-A). The amendment involves changing the permitted land use designation on the 11.99 acre Laurel Tree property from Office and Related Commercial (0) to Residential High (RH 15-23 du/ac) and rezoning the area from Office (0) to Residential Density Multiple with a Qualified Development Overlay (RDM-Q) consistent with the proposed land use plan map change. specific project proposal currently under review by the Commission (CDP #6-96-14) to develop a 138 unit affordable housing project. LCP was submitted concurrent with a specific development proposal, including a Master Plan, for 1,402 acres of the Hunt properties known original ly as the Pacific Rim Country Club and Resort, and now referred to as Aviara. There are two components to the amendment request regarding Planning Areas (PA) 5 and 12 of the Aviara Master Plan. The proposed amendment to Aviara Planning Area #5 allows a land use/product change from multi-family residential to clustered single family homes; proposes development standards for the new single family product type; and revises master plan trail language in the adjacent SDG&E easement. Similarly, the proposed amendment to Aviara Planning Area #12 allows a land use/product change from multi-family to clustered single family homes; and proposes development standards for the new single family product type; No other changes to coastal zone goals, policies or objectives are proposed in either planning area.
