Request: California Lutheran Homes, owner and operator of the Carlsbad by the Sea professional care facility, requests an amendment to the existing certified Local Coastal Plan, LCP. This Local Coastal Plan Amendment, ( LCPA 1, would allow for the renovation of the existing facility to be completed without the introduction of a new land use, (tourist commercial), to the site. The following information and attached application is offered in response to staff determinution that a LCPA would be required for the above listed applications, currently in process with the city. Additionally, it is requested that this LCPA will be processed concurrently with or will not impede the approvals the existing applications. 11. Apprccation Requiremenis (Check List Items requested by stm Jtem 1 : Not Applicable Jtem 7 : Not Applicable Jtem 3 (text changes): see attached Jjem 4: This amendment would allow the renovation and continued use of the Carlsbad by the Sea, Professional Care Facility, which has been in existence at this site for nearly 40 years. This site is located at the intersection of Carisbad Boulevard and Grand Avenue and classified as within LCP SubArea 5. The LCP states that this sub-area is characterized by "local heritage' and that "incidental and compatible uses such as those allowed in the C-2 and R-3 zones may be permmed". This amendment's relevance to and effect on the LCP is limited to section XII, Standards For the Sub-Areas, pages 19 and 20. Within this section, textural clarification would be added to note that this specific existing non-conforming use will be exempt from the tourist/visitor commercial use requirement. It appears that no other sections of the LCP are effected by this requested amendment. Dem 5: The Zoning measures that will implement this LCPA shall include: a. The Carlsbad Village Area Redevelopment Plan b. The Village Design Manual c. The Carisbad Zoning Ordinance, Tile 21 ltem 6 : Not Applicable h LCPA Request Carlsbad by be Sea Page 2 -7: No potential significant adverse Impacts to coastal resources are anticipated os a result of this LCPA. This LCPA would allow for the existing professional care facility use to remain unchanged, therefore minimizing potential Impacts, changes in use patterns or demands on coastal resources. In fact, this professional care facility has little, it any demand on coastal resources, yet as part of this project, enhancement to beach access parking is being proposed. Hems 8 - 19 : Not Applicable Ill. Supplementd Requirements (Additional discussion or justification requested by staft) Addttional analysis to show that existing visitor serving commercial uses are adequate and that adequate land is reserved to meet foreseeable future demands for visitor serving commercial: The need to require Carlsbad by the Sea to Include Travel Service Commercial uses within it's redevelopment and renovation does not appear to be necessary or should be a high priority. The Village LCP goal to promote Travel Service land uses within Sub- Area 5 has been very successful to date. In fact, many properties that were not zoned E have been developed to Include such facilities. Within SubArea 5 and the immediate vicinity, there is approximately 17.47 acres zoned E. Currently there exist approximately 17.60 acres of travel service development within this same area. Additionally, there remains approximutely 4.3 acres of future TS zoned property, excluding the Carisbad by the Sea parcels, which will eventually provide more travel service commercial uses to the area. (see the attached Land Use Study for a detailed breakdown of this area.)
