ADDENDUM TO APPLICATION PACKAGE
OCEAN BLUFF CT 93-09
LOCAL COASTAL PLAN AMENDMENT
As part of the application package for Ocean BlufFCT 93-09 it is necessary to rezone the property from
LC (Limited Control) to R-1 (Single Family Residential). The property is designated as Low Medium
residential use at a density of 0-4 dwelling units per acre on both the Land Use Element of the General
Plan and the Land Use Plan portion of the existing certified Mello I1 LCP and is therefore consistent with
the provisions therein. The requested rezoning simply implements the already certified land use
designation approved for the site.
The Ocean BluB development is regulated by the Mello I1 segment of the Carlsbad Local Coastal
Program One of the basic goals of the Local Coastal Program is to assure that coastal resources are
maintained through orderly and sensitive development. As a result of the Zone 20 Specific Plan Program
Environmental Impact Report (PEIR), several areas within the Zone 20 Specific Plan area were
recommended to be set aside as biological open space to mitigate biological impacts. The proposed
project is consistent with and does not inhibit the implementation of the mitigation measures discussed in
the PEIR. A mitigation program has been proposed by the project that is consistent with the Mello I1
LCP. The site is required to pay an agricultural conversion fee per existing policies to be used for the
preservation of coastal agriculture. Erosion control is guaranteed by the mitigation measures proposed as
a part of the project. The proposed project does not impact any steep slope areas subject to regulations
under Chapter 3 of the Coastal Act.
The proposed application package will not require any text change to the Local Coastal Plan. With the
adoption of the applications being requested, coupled with the condition of approval, implementation of
the policies as contained in the Local Coastal Plan will be achieved

Reproducible 1500 scale map of subject property showing requested Coastal Plan
Designation with the acreage involved and surrounding designations and land uses
if a map change is proposed.
One (1) copy of 8 1/2" x 11" location map (suggested scale 200" -Vicinity maps on
the site plan are not acceptable).
If a text change is proposed indicate where the proposed new text fits into the
certified text. If the text is proposed to be revised, clearly indicate modifications
using strikeouts and/or underlines.
Provide a discussion of the proposed amendments relationship to and effect on other
sections of the previously certified LCP.
List the zoning measures that will implement the LCPA.
Affect on public access (only for area between first public road and the coast).
An analysis of potentially significant adverse cumulative impacts on coastal
resources.
Environmental Impact Assessment Form (Separate fee required).
Public Facility Agreement: Two (2) copies: One (1) notarized original, and one (1)
reproduced copy. (Separate fee required).

- NOTE: WHEN THE APPLICATION IS TENTATIVELY SCHEDULED TO BE
HEARD BY THE DECISION MAKING BODY, THE PROJECT PLANNER WILL
CONTACT THE APPLTCANT AND ADVISE HIM TO SUBMIT THE RADIUS MAP,
TWO SETS OF THE PROPERTY OWNERS LIST AND LABELS. THE
APPLICANT SHALL, BE REQUIRED TO SIGN A STATEMENT CERTIFYING
THAT THE INFORMATION PROVIDED REPRESENTS THE LATEST
EQUALJZED ASSESSMENT ROLLS FROM THE SAN DIEGO COUNTY
ASSESSOR'S OFFICE. THE PROJECT WILL NOT GO FORWARD UNTIL THIS
INFORMATION IS RECEIVED.
A typewritten list of the names and addresses of all property owners
within a 600 foot radius of subject property lincludinn the amlicant
and/or owner). The list shall include the San Diego County Assessois
parcel number from the latest assessment rolls.

a 600 foot radius of subject property. For any address other than single
family residence, apartment or suite number must be included. DO

exterior boundaries of the subject property. Each of these lots shall be

scale of the map may be reduced to a scale acceptable to the Planning Director

013. For residential projects within Vista, Enchitas or San Dieguito School Districts, the
applicant shall indicate whether he prefers to dedicate land for school facilities, to
pay a fee in lieu thereof, or do a combination of these. If the applicant prefers to
dedicate land, he shall suggest the specific land.
For residential projects within the Carlsbad Unified School District and the San
Marcos Unified School District, the applicant shall submit written confirmation that
school facilities will be available to serve the project at time of need.

and landscape plans
Dear Anne:
Enclosed please find (4) sets of the above noted plans and the redlined sets provided by City staff along
with a completed application for a Local Coastal Plan Amendment addressing issues in your May 15,
1995 letter. Many items related to this application are currently on file and are so noted on the check list.
I have discussed the LCPA with Gary Wayne and understand that the filing of this request will not
become enmeshed in the City’s current effort to obtain permit authority.
The affordable housing issue will require at least one meeting to discuss options relating to the discussion
in your last letter. Evan Becker indicates that there is an acknowledgment that requiring the agreement as
outlined in your earlier letter is premature and outside of existing CMC provisions.
This leaves the issue relating to the necessity of amending the specific plan for Zone 20. The applicant
has demonstrated the physical capacity to provide the units on site. He is simply seeking to document that
if an off site solution (physical construction, or the purchase of credits) is approved that the
underlying affordable housing site may convert with limited review of the approved tentative map. Any
off site solution would be subject to an affordable housing agreement that would specify the site (physical
construction or credit purchase). At that time a minor specific plan amendment could be considered, if
the City’s policy does not change in the interim.
I will contact you to set a meeting to discuss this issue. Since you have indicated that the City Attorney’s
Office has played a role in your earlier determination, I would anticipate asking that a representative be in
attendance along with Gary Wayne and possibly Chris DeCerbo.
