SUBJECT: APPLICATION FOR A LOCAL COASTAL PROGRAM AMENDMENT
LCPA 95-09 - OCEAN BLUFF
Dear Deborah:
Enclosed is the City of Carlsbad’s completed application to amend the implementing
zone specified by the Mello II LCP for the subject property. Although the Mello II Land
Use Plan is consistent with the subject parcel’s Residential Low-Medium (RLM) land use
designation, the implementing zone (L-C) is not consistent with the proposed zone
change to R-1 (One Family Zone). This amendment to the LCP implementing zone will
maintain consistency between the City’s General Plan, Zoning Map, and Local Coastal
Program.
The City Council approved LCPA 95-09, along with all other project applications, at the
April 2, 1996, public hearing.
The support documentation specified on the checklist is enclosed.

ATTACHMENT "A
SUMMARY OF AMENDMENT PROPOSAL
Zone change on Ocean Bluff property (APN 215-070-16) from Limited Control (L-C) to
R-1-7500. The project is located within and subject to the Mello II Local Coastal Program
segment and is designated for Residential Low-Medium (RLM) density land use and
Limited Control (L-C) zoning. Although the Mello II Land Use Plan is consistent with the
subject parcel's RLM General Plan designation, the Mello II implementing zone (L-C), an
""interim" zoning allowing agricultural uses, is not consistent with the proposed zone
change to R-1. Since the California Coastal Act specifies that all rezonings related to
land use regulation or administration within the coastal zone, which occur after the
certification of a local government's local coastal program, require a LCP amendment in
order to be effective, the project includes a Local Coastal Program Amendment to
change the implementing zone from L-C to R-1 for the Ocean Bluff parcel.

AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF THE
PREVIOUSLY CERTIFIED LCP
The Zone Change from Limited Control Zone (L-C) to the One-family Residential
Zone with the One-family Residential Zone (R-1-7500) is consistent with the
underlying General Plan and Mello II Segment designation of Residential Low-
Medium (RLM), which allows for residential development at a density range of 0 to
4 dwelling units per acre.
ZONING MEASURES THAT WILL IMPLEMENT THE LCPA
The R-1 , One Family Zone, within Title 21 of the Carlsbad Municipal Code, will be
the new implementation measures for the two properties in question.
AFFECT ON PUBLIC ACCESS
The project is not located within the first public roadway from a lagoon or the
ocean, and will not impact public access to any shoreline areas. The project is
located over 1 mile from the Pacific Ocean and Batiquitos Lagoon.
ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON
COASTAL RESOURCES
The changing of the residential zones from L-C to R-1-7500 within a Residential
Low- Medium (RLM) General Plan Designation does not directly affect physical
coastal resources. The RLM designation allows residential development
irrespective of the specific type of residential zoning.
SUMMARY OF MEASURE TO ENSURE BOTH PUBLIC AND AGENCY

The project underwent substantial public review, including a duly noticed six-week
LCP amendment review period opened on August 31, 1995, notification of the Prior
Environmental Compliance for public agency review, and duly noticed Planning
Commission and City Council public hearings. No comments regarding the LCP
amendment were received during those public review periods and public hearings.
