Specifically, this LCP amendment will recognize master plan text and graphic changes which establish certain development standards for the development of a detached, clustered single family product type. An LCP amendment is needed in this case since the implementing ordinance for the LCP area (Aviara Master Plan) was amended. This amendment to the LCP is proposed to maintain consistency between the City’s General Plan, zoning ordinance and LCP/coastal regulations. The City Council approved the PA 5 project on December 19, 1995 which included the subject LCP amendment (LCPA 95-11), a major master plan amendment (MP 177(P)), and tentative map revision (CT 9O-O9(A)), and a new condominium permit (CP 95-01) for the proposed air space ownership product type. The support documentation specified on the application checklist is enclosed. Amendment's relationship to and effect on other sections of the previously certified LCP The proposed LCP Amendment will reflect changes to the Aviara Master Plan, the implementing ordinance for the LCP in this area, which will allow a product type change and establishment of development standards pertinent to the new product type. The project site already has City approval for 147 multi-family units; this proposal consists of 131 detached clustered single family units. Therefore, the effect on other sections of the certified LCP and coastal resource policies and objectives will be non-existent. Zoning measures that will implement the LCPA The criteria and development standards of the Planning Area 5 chapter of the Aviara Master Plan, which is the implementing ordinance for this LCP area, constitute the zoning measures that will implement the proposed LCPA. Analysis of potentially significant adverse cumulative impacts on coastal resources Since the site already has an approval for 147 multi-family units, and the site itself is pre-graded in accordance with the mass grading of Aviara Phase II, and the site and existing approvals are consistent with master plan, General Plan and LCP provisions; the proposed changes to PA 5 will not create any potentially significant adverse cumulative impacts on coastal resources Summary of measures to ensure both public and agency participation The proposed LCP amendment (LCPA 95-1 1) was concurrently processed with a major master plan amendment (MP 177(P)), tentative map amendment (CT 90- 09(A)) and a new condominium permit (CP 95-01). The entire entitlement package undewent the City's prior compliance process for environmental review based on the Aviara EIR and previous environmental review for the existing approvals on PA 5. This process includes a 30 public review and comment period. No written comments were received. The LCP amendment itself underwent the standard 6 week public review and comment period from September 27 to November 8, 1995. No written comments were received.
