Clemens 201 1 Palomar Airport Road, #206 Carlsbad, CA 92009 Re: Coastal Development Permit Application #6-84-6 17/Amendment Request Dear Mr. Clemens: This letter is in regards to the status of the above coastal development permit. As you know, the above permit was approved by the Commission in 1985 when the Commission adopted the Kelly Ranch Master Plan as the Commission’s standard of review for the Kelly Ranch property. The permit was subsequently vested with recordation of offers of dedication (open space) and some grading and infrastructure improvements. While the City of Carlsbad has subsequently obtained a certified LCP in the Mello II segment, it is our position that CDP #6-84-617 is still in effect and must be amended to incorporate the proposed changes to the existing Kelly Ranch Master Plan. The amendment application must (1) describe all components that will remain in the Agua Hedionda Lagoon segment; (2) describe what was already done; and (3) describe what changes are proposed in the Agua Hedionda Lagoon segment. Please submit the attached assignment (because the property has changed ownership since the Commission’s action) and amendment applications to this office as soon as possible. The amendment application should include all of the following information. Regarding the “Substantial Conformance Exhibit-Limits of Grading Overlay”, please provide a characterization of the areas where development has expanded from CDP #6- 84-617. Please provide an analysis of why development is currently proposed in those areas where it was not previously approved in the master plan. An analysis of how the proposed slope encroachment for “access to flatter, developable areas” is the least environmentally damaging alternative road alignment. While the Mello II LCP allows impacts to dual criteria areas for construction of roads access to flatter areas, it requires that such access must be the least environmentally damaging alternative. No such alternatives analysis has been submitted in this regard; please provide one. Also, please provide a copy of the CC&Rs that reference the Callahan site (Planning Area “L‘*), a revised open space exhibit for Area “B” showing the area has been increased to 192.5 acres, the status of the wetland dedication of Area “B to the Wildlife Conservation Board (i.e,, when is the dedication expected to be accepted, do you have a D.L. Clemens August 4,1999 Page 2 copy of the proposed document, if so, please provide it). Finally, indicate in the amendment request that it is understood no authorization for work not completed in the Commission’s previous approval of the master plan is being sought by the proposed amendment. The above information must be provided as soon as possible, but no later than August 13, 1999 for the amendment to be considered on the Commission’s September, 1999 hearing in Eureka. However, it should be noted that based on the acceptability of any suggested modifications that may occur as a result of our review of the local coastal program amendment relative to this site, the appeal of the City’s coastal development permit approval (CDP# 97-43) and the amendment to CDP #6-84-617 will not be scheduled for hearing before the Commission until the LCP issues are resolved.
