KELLY RANCH - LOCAL COASTAL PROGRAM AMENDMENT
Dear Ms Sarb:
As you know, the City of Carlsbad has submitted an application to amend the Local Coastal
Program (LCPA) for the Kelly Ranch project. The Carlsbad City Council recently approved
the Kelly Ranch Tentative Map, Coastal Development Permit (CDP), and several other
legislative matters pertaining to the map. The CDP and other actions were approved
subject to the Coastal Commission's approval of the subject LCPA, so the City's action on
these are not yet final. It is our understanding that the Coastal Commission has appealed
the Coastal Development Permit action for procedural reasons, and that the Kelly Land
Company has waived the appeal time period so as to give both the coastal staff, the City,
and Kelly Land Company more concentrated time to work together in the processing of the
LCPA (with the appeal to be dealt with at an appropriate time).
It is the purpose of my letter to express the City's support for processing the Kelly Ranch
LCPA in an expedited fashion so as to agendize this item on your regularly scheduled
August Coastal Commission hearing in Los Angeles. The Kelly Ranch project is especially
important to the City of Carlsbad because of an essential circulation road that will be
constructed with the project - Cannon Road from El Camino Real to Macario Canyon. This
important major arterial roadway will provide a much needed east-west link that will help
relieve the congestion on Palomar Airport Road, assist access to Legoland, and create a
much needed coastal access from El Camino Real to Carisbad Boulevard (Coast Highway).
In order for Cannon Road to build and open in June of 2000, the project must start grading
in August, 1999. Both habitat and wildlife constraints, and the coastal grading
moratorium, will cause the Cannon Road project to be delayed between 6 and 12 months
if the grading is delayed past August. Although the City currently has a Coastal Permit for
the construction of Cannon Road, it is not logistically possible to construct Cannon Road
independent of the mass grading required for Kelly Ranch because of the alluvial soils
conditions in the area.

So, as you can see, it is vitally important that the Kelly Ranch LCPA be processed so as to
be scheduled for the August Coastal Commission hearing. The City has helped Kelly Land
Company process the necessary engineering improvement plans and Final Subdivision
Map so to be ready to issue a grading permit immediately upon receiving an approval from
the Coastal Commission.
Finally, please do not construe the City’s support for expedited processing of the Kelly
Ranch LCPA as a substitute for our request to have the Carlsbad Ranch Overlay Zone LCPA
considered by the Commission at its August 1999 meeting. The Overlay Zone Urgency
Ordinance expires at the end of August and it is critical that the Overlay area not be
without the protection afforded by the Zone Code Amendment you are currently
processing as a LCPA.
