Dear Mr. ”i’,yne:
Thank you for your May 25,1999 submittal of the City’s application for Carlsbad Local
Coastal Program Amendment 2-99. Section 13553 of the California Code of Regulations
states “[aln amendment to a certified LCP or LRDP together with all necessary
attachments and exhibits shall be deemed “submitted” after having been received and
found by the executive director of the Commission to be in proper order and legally
adequate to comply with Public Resources Code Section 30150(b). Said review shall be
completed within a reasonable time, but unless there are unusual circumstances, no later
than ten (10) working days after the date it is received in the Commission offices during
normal working hours [. . .Iy’ (emphasis added). Given the size of the submittal and the
current pending workload for the June and July Commission meetings, it will be
necessary for us to have additional time to complete our review of the submittal and
determine its adequacy and suitability for filing.
However, based on staffs review at this point, we can identifjl the following
supplemental information or exhibits that will be necessary to allow us to complete our
review:
0 Full-scale copies of the submitted exhibits, including CT 97-16 as amended, HDP 97-
17, CDP 97-43, PUD 99-02, Exhibits A-M (April 7,1999), Revised Open Space
Exhibit €or LCP Open Space Easement, Landscape Concept Plan (including Refined
Landscape Zone) and Kelly Ranch “Core Area” Map;
0 An exhibit clearly comparing the development area of the existing Kelly Ranch
Master Plan development to the proposed development; and
0 Any Visual Impact Analyses for the Kelly Ranch project
In addition, staff would like to discuss with you the possibility of a time extension for
processing this LCP in order to allow the project to be heard at the October 12-14, 1999
Commission hearing in San Diego. Scheduling the hearing at this time and location
would allow for the greatest amount of public participation in this significant amendment
to the Carlsbad LCP. If the City wants to go forward with the CommerciaWisitor
Serving Overlay Zone before the October hearing, please request that it be expedited and
the remainder of the amendment be delayed.
