SUMMARY OF AMENDMENT PROPOSAL
An amendment to the Mello II segment zoning map to change 40.41 acres from
Limited Control (L-C) to Residential Multiple Density with a Qualified
Development Overlay Zone (RD-M-Q) and to change 41.79 acres from Limited
Control (L-C) to One-Family Residential with a Qualified Development Overlay
Zone (R-I-Q) to maintain consistency between the Local Coastal Program and
the City’s zoning map. The property is located on the northeast corner of
Poinsettia Lane and Aviara Parkway.

3. AMENDMENTS RELATIONSHIP TO AND EFFECT ON OTHER SECTIONS OF
THE PREVIOUSLY CERTIFIED LCP
The proposed LCP amendment involves only a rezone of the subject property
within the Mello II segment. This rezone would bring the zoning of the property
into conformance with the existing General Plan land use designation
(Residential Low Medium). Given the focused nature of the proposed
amendment, the action will have no effect on other sections of the previously
certified LCP.
4. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA
The implementing zoning will include. the Residential Multiple-Density (RD-M)
and the One Family Residential (R-I) zones (Chapters 21 .IO and 21.24 of the
Carlsbad Municipal Code, respectively), as well as the Qualified Development
Overlay Zone (Chapter 21.06 of the C.M.C.)
5. AFFECT ON PUBLIC ACCESS
The Thompsonmabata project site is located 1.1 miles from the Pacific Ocean
and 0.75 miles from the Batiquitos Lagoon and is surrounded by improved public
streets with sidewalks. No shoreline access provisions apply to the project and
adequate public access exists around the site.
6. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE
IMPACTS ON COASTAL RESOURCES
The Thompsonmabata site is designated for residential development in the Mello
II Land Use Plan. The previously agricultural site is designated as Site Ill in the
Mello II Land Use Plan, therefore the project has been conditioned to pay the
appropriate agricultural conversion mitigation fee (Condition No. 10 of Planning
Commission Resolution No. 5078). All future grading for the proposed residential
development will conform to the City of Carlsbad standards thereby ensuring that
no adverse impacts due to erosion or siltation would occur. The existing 1.8
acre strip of Coastal Sage Scrub will remain undisturbed by grading operations
and will be placed in permanent open space. Therefore, the proposed LCP
amendment will have no significant adverse cumulative impacts on coastal
resources.
8. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY
PARTICIPATION
The Local Coastal Program Amendment was duly noticed for over the six-week
period, from June 29, 2000 to November 7, 2001 and no comments were
received. The proposed amendment was also reviewed through the duly noticed
public hearings before the Planning Commission and City Council, as listed
below:
