Re: Certification of Major Amendment 2-99A (CommerciaWisitor-Serving Overlay)
Dear Mr. Munoz:
On August 12,1999 the California Coastal Commission approved the above referenced
amendment request. In its action, the Commission adopted the addition to the Carlsbad
Implementation Plan with a modification addressing the amendment’s conformance with
the certified Local Coastal Program Land Use Plan. The attached modification contains
the specific changes adopted by the Commission.
Before the amendment request can become effectively certified, the Executive Director
must determine that implementation of the approved amendment will be consistent with
the Commission’s certification order. This is necessary because the amendment was
certified with suggested modifications.
In order for the Executive Director to make this determination, the local government must
formally acknowledge receipt of the Commission’s resolution of certification, including
any terms or suggested modifications; and take any formal action which is required to
satisfy them, such as rezonings or other ordinance revisions.
As smn as the necesswj dwumentation is received in this office and accepted, the
Executive Director will report hisher determination to the Commission at its next
regularly scheduled public hearing. If you have any questions about the Commission’s
action or this final certification procedure, please contact our office. Thank you and the
other staff members who worked on this planning effort. We remain available to assist
you and your staff in any way possible to continue the successful implementation of the
local coastal program.

CARLSBAD JXP AMENDMENT #2-99A (COMMERCIAL VISITOR-SERVING
1. Section 2 1.208.40 of the City’s Zoning Code lists permitted uses in the
commercial visitor-serving overlay zone. Section 21.208.40 of the Zoning Code shall
be revised as fdlows:
WommerciaVVisitor-Serving Uses are permitted uses, in the overlay zonedf
thev meet the reauirements of this Chapter. The only permitted uses in the overlay zone
are the residential, industrial and office uses authorized as permitted uses by the zoning
of the underlying zone, which are not subject to the provisions of the Chapter. Those
uses shall be developed subject to the development standards and entitlement processes
required by their underlying zoning. In addition, a roadside stand for the display and sale
of products on the same premises is an allowed use provided that the floor area shall not
exceed two hundred square feet and is located a minimum of 20 feet from any street,
highway or city right-of-way.
