The package includes five separate actions taken by the City to amend the City’s Zoning Ordinance and LCP Implementation Plan. Section 13553 of the California Code of Regulations states “[aln amendment to a certified LCP or LRDP together with all necessary attachments and exhibits shall be deemed “submitted” after having been received and found by the executive director of the Commission to be in proper order and legally adequate to comply with Public Resources Code Section 30150(b). Said review shall be completed within a reasonable time, but unless there are unusual circumstances, no later than ten (10) working days after the date it is received in the Commission offices during normal working hours [. . .I”. Staff has completed the initial review of the LCPA package. The following additional information is necessary in order for staff to determine the LCP package is complete and properly submitted. First, the mailing lists which have been submitted for the five separate actions include the Appendix A or Governmental Agencies list, and a list titled Interested Parties which are the same for all five actions. Please confirm whether or not there is an additional list for each item that would inciude adjacent property owners and residents and/or other interested parties such as persons who have submitted written or oral comments for the local hearings. If such a list exists, please provide each list for each of the 5 City actions. - Additionally, for LCPA 98-08 Carnation Property, a question was raised regarding provision of sewer service to surrounding unsewered properties. Please submit an explanation and a graphic representation of the existing sewer system within Zone 20, which properties are currently without sewer and potential alignmentdocations and capacity of future sewer lines to serve those and the subject properties. We are particularly interested in any sewer system which may be located outside of the street system within open space or environmentally sensitive habitat areas. Finally, for LCPA 98-07 Hadley, please submit a written explanation as to why the proposed open space lot is not being zoned Open Space with this rezone. October 21, 1999 Page 2 The submittal involves an amendment to the LCP Implementation Plan and has been classified a major amendment. As a major amendment, the Coastal Commission has 90 days to review a land use plan revision or 60 days to review an implementation plan modification. Therefore, depending on when the above information is received, it is likely that either a time extension or the LCP amendment must be scheduled for the December 7-10,1999 Commission hearing in San Rafael. Due to workload constraints and the fact that Commission staff is currently working on Carlsbad LCPA #2-99D Kelly Ranch, we anticipate it will be difficult to process the entire submittal for the December hearing, therefore, a time extension would be necessary. Please let us know if there are any reasons why a time extension until the January 11-14,2OOO meeting in Santa Monica is a problem and if there is an order of priority for which City actions we should process first. Your letter indicated the need for information which is provided in this letter and related attachments. The first information request was to confirm the notification of adjacent property owners for each of the five LCPA actions. Two of the subject actions, Appellate Procedures and IODA II, are ciwde zone code amendments and as such, do not involve a project site or adjacent property owners. Only the LCPA interested parties list was used for these items; adjacent property owner notification was not applicable. The other three items (NAMM, Hadley and Carnation) do involve a specific project site and adjacent property owner notifications. The property owner lists, as requested by your letter, are re-submitted for your review as attached to this letter. The second information request was a written and graphic overview of Zone 20’s sewer system as part of the Carnation project. The requested overview is attached to this letter. The third information request was a written explanation of the open space lot in the Hadley project and the lack of an open space zoning designation. That requested explanation is also attached to this letter. With regards to Coastal Commission hearing dates, the City is willing to accommodate your desire to consider these items no later than the January 2000 hearings in Santa Monica with the exception of NAMM (LCPA 98-10). The NAMM project is very minor (opening of their music museum for public use) and they have been waiting some time for Coastal Commission processing. The City’s willingness to consider this batch in January 2000 is based on considering the NAMM item in December 1999.
