SUI"€ 103 SAN DIEGO, CA 921064402 (619) 7674370 State of California San Diego District MEMORANDUM / TO: Commissioners and DATE: July 19,2001 Interested Persons '1 ' FROM: Staff Tue 9g SUBJECT: Request to Waive Time Limit for Carlsbad LCP Amendment No. 1-2001 (B and C) for the Commission Meeting of August 6-10,2001 On June 22,2001, the City of Carlsbad's proposed Local Coastal Program Amendment (LCPA) #1-2001 was filed in the San Diego District office. The amendment package contains three separate LCP amendments. Two of the amendments would amend the certified Carlsbad LCP implementation program to rezone the 5.0 acre Buerger site from L-C to One-Family Residential (R-1-7,500-Q) and Open Space (0-S) with a Qualified Development Overlay Zone (Q designator) and rezone the 5.0 acre Tabata site from L-C to One-Family Residential (R- 1-7,500-4) with a Qualified Development Overlay Zone. Pursuant to Section 305 12 of the Coastal Act, an implementation plan amendment must be acted on by the Commission within 60 days of complete submittal. To be heard within the allotted time period, the amendment request would have to be agendized for the scheduled August 2001 hearing. However, Section 30517 of the Coastal Act and Section 13535 of the Code of Regulations state that the Commission may for good cause extend a time limit for a period not to exceed one year, after consultation with the local government and by a majority vote of the Commissioners present. Commission staff is requesting the time extension to respond to issues associated with conversion of the L-C properties which are currently an agricultural holding zone, to urban development. Summarv of Staff Recommendation. Staff recommends the Commission extend the 60- day time limit for a period not to exceed one year. MOTION: I move that the Commission extend the 60-day time limit to Carlsbad LCP Amendment No. 1-2001(B and C) for a period not to exceed one year. STAFF RECOMMENDATION: Staff recommends a yEs vote. An affirmative vote of the majority of the Commissioners present is needed to pass the motion.
