Section 13553 of the California Code of Regulations ststeE "[aln amendment to a certified LCP or LRDP together with all necassary attachments and exhibits shall be deemed "submitted" after having ban received and found by the cxccutivt director of the Commission to be in proper order and legally adequate to comply with Public Resources Code Section 30510(b). Said miew shall bo completed within a reasonable time, but unless there are unusual circumstances, no later than ten (IO) working days after the date It is received in the cornmission offices during normal worlring hours f.. .I1*. As you arc aware, staff completed the initial review of the LCP amendment package within the initial 10 day time period and through a letter doted 3/30/00 from Bill Ponder, this offlce identified sevd items which the Izxecutivo Dircctor determines am necessary to complete tho submittal and deem it suitable for filing. With your response lcttcr dated 4/13/00. you included several of the requested items, but asked that wa idcntify thc legal authority for squiring the biological surveys, fire suppression plans and resource agency approvals associated with the Manzanita, Rocsch and Stcincr submittals. Section 13552' of the Commission's achdnistrative regulations titled or LRDp states ia applicable part: Thc u3p or LRDP amendment Irubdttai shall include: (a) .... (b) All policies, plane, st8ae, objectives, diegrpms, drawhp, maps, photomhs, and supplementary data, related to the amendment in suillcient detail. to allow review for conformity with the requirements of the Coastal Act. .. ., (C),.. (d),.. (e) Any environmental review documents, purauant to -A, required for all or any portion of thc amendment to the LxlP or LRDP.. . .. (f).... We believe the above stated regulation gives staff the suthodty to request this information and that this infodon is necessary in order to find the LCP package is “in proper order and refly adequate to comply with Public Resourax Cod0 Swtlon 30SlO(b)”. That section of the statute atam: Consistent with this chapter, a PIopOaed local coastal program may be submitted to thc commission, if both of the foilowing am met: (a) It is submitted pursuant to a resolution adopted by the local pvemment, after public hearing that ctrtifia the local cOllst81 pro- is intended to be carried out in a manner fully in conformity with this divioion. (b) It contains, in accordance with the picklints cstabIirbed by the commission, materids sufficient for thorough and complets review. The submittal involves an amendment to the KP Implementation Plan and has been classified a major amendment. As a major amendment, the Coastal Commission has 60 days to mviow an implcmentatiou plan modffication. ”huefore, upon receipt of the requested infomation and completion of the subdttal, we will schedule the LCP amendment for the appropriate Commirsion agenda. Due to workload constraints and the fact that Commission std€ irr currently workin8 on Carlsbad LCPA m99D Kelly Ranch, we antidpate it wiU be dimcult to process the entire submittal within the required time period, therefore, a time extension may be necessary. Please 1st uti know if thm is any order of priority for which portions of the submittal shouId be processed first, and/or if the City is interested in wgmtnting the rubmittal in any way. At tbir tima the entim submittal is considered incomplete and not yet filed for purposes of the 6oaay time limit.
