ACTION ON S U GG ESTE D MOD I F I CAT1 0 N S PRIOR COMMISSION ACTION ON THIS SUBMITTAL? - N - N/A SUMMARY OF AMENDMENT PROPOSAL To amend Chapter 21.85 of the Zoning Ordinance, the “lnclusionary Housing Ordinance.” The current Ordinance requires residential projects to either construct housing affordable to lower-income households or pay fees in-lieu of construction. The proposed amendment would, among other things, allow alternatives to new residential construction, add “extremely low income” as a new class of affordable housing and household, and provide incentive credits for developers to assist the City in meeting its affordable housing needs. Some of the changes are proposed to make the lnclusionary Housing Ordinance consistent with the regionally-adopted guidelines for the housing element self- certification pilot program. The recommended amendment, affecting properties city-wide, is not associated with any specific development project and does not propose any development. In California Coastal Commission Application for LCPA 99-06 March 16,2000 Page 2 addition, it does not affect any General Plan or zoning designation, allowable densities or land uses, or any environmental plan. Approval of the requested LCPA will ensure consistency between the City’s amended zoning regulations and the Local Coastal Program. The amendment does not propose any map changes. V. VI. AMENDMENTS RELATIONSHIP TO AND AFFECT ON OTHER SECTIONS OF THE PREVIOUSLY CERTIFIED LCP Changes proposed to the lnclusionary Housing Ordinance represent a zoning text amendment of the Carlsbad Local Coastal Program. It affects all six segments of the LCP. However, the proposed amendment revises only the affordable housing requirements contained in Chapter 21.85 of the Zoning Ordinance; no other sections of the previously certified LCP are affected. Additionally, the proposed amendment is not associated with any specific project and proposes no development, will not change any density, land use designation, or allowed or prohibited land uses, and will not affect any environmental plan. It will also not relieve any developer/project from full compliance with all applicable Coastal regulations. Approval of the proposed LCP Amendment would establish consistency with the City’s zoning regulations. 2. ZONING MEASURES THAT WILL IMPLEMENT THE LCPA A Zone Code Amendment (ZCA 99-08) was approved to achieve consistency with the proposed Local Coastal Program Amendment. 3. AFFECT ON PUBLIC ACCESS The project area is Citywide. Consequently, the amended Code could be applied at a variety of residentially-developable locations. However, the amendment does not change any permitted or prohibited land uses nor any land use designations or development standards that might affect public access. It also does not relieve any developer/project from any otherwise applicable Coastal Zone regulations to provide public access. Therefore the project will have no affect on public access. 4. ANALYSIS OF POTENTIALLY SIGNIFICANT ADVERSE CUMULATIVE IMPACTS ON COASTAL RESOURCES The project will have no potentially significant adverse cumulative impacts on Coastal resources. The project proposes no development and will not change any land use designations or currently allowed or prohibited land uses. It will also not relieve any developer/project from full compliance with all applicable Coastal regulations. SUMMARY OF MEASURES TO ENSURE BOTH PUBLIC AND AGENCY PARTI CI PATlON Review of the proposed amendment to the lnclusionary Housing Ordinance began at the Housing Commission on August 12, 1999. On that date, the Housing Commission held a public meeting and recommended approval of the amendment to the Planning Commission and City Council. The Housing Commission is an advisory body only, and there was no public hearing notice or minutes published for its review of the proposed amendment. LCPA 99-06 underwent a six (6) week public review period from December 23, 1999 through February 3, 2000. The enclosed public notice of the LCP amendment was mailed to the 65 interested partiedagencies on the attached list and published in the North County Times and the Coasf News. The City received no comments regarding the proposed Local Coastal Plan Amendment during the six week period. On January 19, 2000, a public hearing before the Planning Commission was held regarding LCPA 96-06 and ZCA 99-08, with the Commission recommending approval. On February 8, the City Council held and continued the public hearing on the lnclusionary Housing Ordinance Amendment to February 15, 2000. On the the City Council adopted Resolution No. 2000-52, approving LCPA 99- 06, ZCA 99-08, and the related negative declaration. On March 14, the City Council introduced Ordinance No. NS-535, amending the lnclusionary Housing 0 rd inance . Both the Planning Commission and City Council public hearings were publicly noticed. For each hearing, a notice was published in the North County Times and mailed to the 149 interested partiedagencies on the attached list and the 56 interested partiedagencies previously mentioned.
